February 26, 2002 <br /> <br />· Section 35-216(a) Division 4: The included census tracts should reflect the 2000 <br />Census for accuracy and consistency. The Empowerment Zone was not incorporated <br />into the Code upon designation in 1999. Section 35-216(a) reflects an incentive offered <br />in the Empowerment/Enterprise Zone. The City is also in the process of applying for an <br />expansion of the Empowerment Zone to include a portion of Census Tract 2114 <br />containing the proposed Midtown Conservation and Redevelopment Area. It is <br />necessary to show that the current Empowerment Zone has been incorporated into City <br />Code. <br /> <br />Financial Impact: <br /> <br />· Empowerment and Enterprise Zone incentives make sites such as Victory Crossing <br />more attractive to developers and businesses. The Victory Crossing business park and <br />shopping center components are expected to generate $128.5 million in private <br />investment and over 2,700 jobs. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt an ordinance. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Benn, to defer consideration of 02-54 <br />to the meeting of March 12, 2002, and was adopted by unanimous vote. <br /> <br />02 - 55 - Adoption of an ordinance to amend and reordain the Code of the City of <br />Portsmouth by adding thereto a new section, number 37-101.1, dealing with appeal <br />from denial of a public vehicle driver's permit. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend and reordain the Code of the City of Portsmouth <br />by adding thereto a new section, number 37-101.1, dealing with appeal from denial of a <br />public vehicle driver's permit. <br /> <br />Purpose and Need: <br /> <br />· Section 37-101.1 will allow for persons to appeal to the Chief of Police or his <br />designee their ineligibility to obtain a permit to operate a taxicab. <br /> <br />· An applicant who is ineligible for a permit because of a conviction under Section <br />37-101(a) of a crime against the person or involving the possession or use of a weapon, <br />or a conviction under 37-101(b) of a felony involving an illegal substance shall be <br />eligible to appeal the denial, but only if the conviction occurred at least fifteen years <br />prior to the application and if the applicant has been of good behavior since the <br />conviction. <br /> <br />· This action will allow for persons who have been found to no longer pose a public <br />safety risk to operate a taxicab in the City. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact on the City. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND AND REORDAIN THE CODE OF THE CITY OF <br />PORTSMOUTH BY ADDING THERETO A NEW SECTION, NUMBER 37-101.1, <br />DEALING WITH APPEAL FROM DENIAL OF A CERTIFICATE OF PUBLIC <br />CONVENIENCE OR A PUBLIC VEHICLE DRIVER'S PERMIT." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
