February 26, 2002 · Section 35-216(a) Division 4: The included census tracts should reflect the 2000 Census for accuracy and consistency. The Empowerment Zone was not incorporated into the Code upon designation in 1999. Section 35-216(a) reflects an incentive offered in the Empowerment/Enterprise Zone. The City is also in the process of applying for an expansion of the Empowerment Zone to include a portion of Census Tract 2114 containing the proposed Midtown Conservation and Redevelopment Area. It is necessary to show that the current Empowerment Zone has been incorporated into City Code. Financial Impact: · Empowerment and Enterprise Zone incentives make sites such as Victory Crossing more attractive to developers and businesses. The Victory Crossing business park and shopping center components are expected to generate $128.5 million in private investment and over 2,700 jobs. Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt an ordinance. Motion by Mr. Pitts, and seconded by Mr. Benn, to defer consideration of 02-54 to the meeting of March 12, 2002, and was adopted by unanimous vote. 02 - 55 - Adoption of an ordinance to amend and reordain the Code of the City of Portsmouth by adding thereto a new section, number 37-101.1, dealing with appeal from denial of a public vehicle driver's permit. Recommendation: · Adoption of an ordinance to amend and reordain the Code of the City of Portsmouth by adding thereto a new section, number 37-101.1, dealing with appeal from denial of a public vehicle driver's permit. Purpose and Need: · Section 37-101.1 will allow for persons to appeal to the Chief of Police or his designee their ineligibility to obtain a permit to operate a taxicab. · An applicant who is ineligible for a permit because of a conviction under Section 37-101(a) of a crime against the person or involving the possession or use of a weapon, or a conviction under 37-101(b) of a felony involving an illegal substance shall be eligible to appeal the denial, but only if the conviction occurred at least fifteen years prior to the application and if the applicant has been of good behavior since the conviction. · This action will allow for persons who have been found to no longer pose a public safety risk to operate a taxicab in the City.
