That the use permit is approved subject to the following conditions: (a) All exterior alternations to the property, including signage and landscaping, must receive prior approval from the Downtown Design Committee which may, in keeping with its guidelines, require alternative features. (b) The hours of operation shall be limited to between 11:30 a.m. and 2:00 a.m. daily. Occupancy of the facility shall be limited to eighty persons, subject to approval of the table arrangement and layout by the Building Official. (c) All activities conducted on this site shall be in compliance with Section 24-255 of the City Code pertaining to loud disturbances and unnecessary noise or sound. (d) The applicant shall develop a plan for trash storage, handling, and removal, and the plan must be approved by the City's Director of General Services prior to commencement of operations. (e) The applicant and any successor in interest shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (f) All taxes and fees in connection with the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Recommendation: · Adoption of an ordinance to amend the Code of the City of Portsmouth as follows: (a) To remove Section 7-140 entitled "Waiver of fee for work in Urban Enterprise Zone." · (b) To amend Section 35-216(a) Division 4, pertaining to rehabilitated real estate in Urban Enterprise Zone, by updating the current designated Enterprise Zone census tracts to reflect the 2000 Census and adding the census tracts designated as the Federal Empowerment Zone and Virginia Enterprise Zone in 1999. Purpose and Need: · Section 7-140: The original Enterprise Zone application contained a 10-year sunset clause that expired in 1994. The City of Portsmouth is no longer obligated to offer the fee waivers. As of March 2001, permit fees were no longer being waived in the Enterprise Zone.
