February 26, 2002 <br /> <br />UP-02-01 <br /> <br />Beginning at the northwest corner of the intersection of Green <br />Street and Queen Street; thence, north 85'+ to a point; <br />thence, west 93'+ to a point; thence, south 85'+ to a point; <br />thence, east 93'+ to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) All exterior alternations to the property, including signage and <br />landscaping, must receive prior approval from the Downtown Design Committee which <br />may, in keeping with its guidelines, require alternative features. <br /> <br /> (b) The hours of operation shall be limited to between 11:30 a.m. and <br />2:00 a.m. daily. Occupancy of the facility shall be limited to eighty persons, subject to <br />approval of the table arrangement and layout by the Building Official. <br /> <br /> (c) All activities conducted on this site shall be in compliance with Section <br />24-255 of the City Code pertaining to loud disturbances and unnecessary noise or <br />sound. <br /> <br /> (d) The applicant shall develop a plan for trash storage, handling, and <br />removal, and the plan must be approved by the City's Director of General Services prior <br />to commencement of operations. <br /> <br /> (e) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all necessary licenses and permits. <br /> <br /> (f) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />02 - 54 - Adoption of an ordinance to amend Section 7-140 of the Code of the City of <br />Portsmouth related to waiver of fee for work in Urban Enterprise Zone and Section <br />35-216 related to rehabilitated real estate in Urban Enterprise Zone. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend the Code of the City of Portsmouth as follows: <br /> <br /> (a) To remove Section 7-140 entitled "Waiver of fee for work in Urban Enterprise <br />Zone." <br /> <br />· (b) To amend Section 35-216(a) Division 4, pertaining to rehabilitated real estate in <br />Urban Enterprise Zone, by updating the current designated Enterprise Zone census <br />tracts to reflect the 2000 Census and adding the census tracts designated as the <br />Federal Empowerment Zone and Virginia Enterprise Zone in 1999. <br /> <br />Purpose and Need: <br /> <br />· Section 7-140: The original Enterprise Zone application contained a 10-year sunset <br />clause that expired in 1994. The City of Portsmouth is no longer obligated to offer the <br />fee waivers. As of March 2001, permit fees were no longer being waived in the <br />Enterprise Zone. <br /> <br /> <br />
