32.5' December 12, 1995 "The City ~nd~School staffs have recently completed very favorable negotiations with the Environmental Protection Agency over the former landfill located next to Lakeview Elementary School. The EPA has agreed to the City of Portsmouth's implementation of future actions with regard to this site. It was agreed to by EPA that no present danger to the public exists on this site. One of the long-term precautionary measures recommended was the installation of a gravel vent trench between the School and the landfill to eliminate the possibility of any future migration of methane gas. On December 5, 1995, bids were received on the proposed trenching work as shown on Attaclunent No. 1. The resulting total cost is as follows: Construction Contract (Rock-Ray Drilling, SCS Engineers Fill Material (Park and Ride Parking Lot) Contract Administration Inc.) $15,300 $12,000 $25,000 $ 1,500 TOTAL ANTICIPATED COST $53,800 The Director of Public Works recommends award of a contract to the low bidder, Rock-Ray Drilling, Inc., and an appropriation in the amount of $53,800. I concur with the Director of Public Works and, with your approval of this item, the balance in the Capital Improvement Fund will be $2,549,675." Motion by Mr. Clemons, and seconded by Mr. Robinett, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE TO APPROPRIATE $53,800 FROM THE CAPITAL IMPROVEMENTS FUND FOR THE INSTALLATION OF A VENT TRENCH ON THE NORTH SIDE OF LAKEVIEW ELEMENTARY SCHOOL." Ayes: Ctemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None Motion by Mr. Robinett, and seconded by Mr. Martin, to award a contract to Rock-Ray Drilling, Inc., for installation ol a vent trench on the north side of Lakeview Elementary School, and was adopted by the following vote: Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None 95-550.- Letter from the City Manager recommending adoption of an ordinance to amend Section 32-21 of the City Code pertaining to streets, sidewalks and local improvements. "The Development Codes Committee was established in July 1995 under the chairmanship of Councilman James T. Martin. One of the Committee's missions is to recommend changes in the City Code which will make Portsmouth more attractive to developers. Some of the recommendations involve rescinding the requirement of internal curbs and gutters around parking lots in industrial/commercial areas, and giving the City Engineer the discretion to waive the street improvement requirements of curbs, gutters, and/or sidewalks in certain conditions. These changes are addressed in the proposed amendment tc Section 32-2~ of the City Code. I recommend approval of the attached ordinance in accordance with the recommendation of the Development Codes Committee."
