At a regular meeting of the City Council held March 13th, 1934, there were pres - <br /> <br /> Vernon A. BrOoks, Leslie T. Fox, W.R. Hutchins, Arthur Mayo, $.B. Moore, <br /> ~J. Alden Cast, Archibald Ogg and City Manager. <br /> <br /> Minutes of regular meetSng held February 27th, were read and approved. <br /> <br /> The following communications from the Oity Manager were read: <br /> <br /> let - "I submit herewith a proposed lease between the City and George T. McLean <br />Company, Inc., for the lease-of land at the east end of South St., east of the land occupied <br />by the Seaboard Air Lime Railway Company, for a te~m of one year from March 1st, 1934, at an <br />annual rental of $24.00 payable semi-a~ually. <br /> This land is dest~d bT the George T. McLean Company in the operation of a <br />large cement plant which they have built an~ are operating on adjoining property. 2he eeme~ <br />plant which has been built by the McLean Company is one cf the largest and most modem in thin <br />section of the State. The McSean Companynow has several large contracts which will keep thei~ <br />plant in operation for several months and will give regular employment to quite a few people. <br />They. are receiving materials daily by both train and boat. ' <br /> I have gone over this property with the city Attorney and Y~r, McLean and <br />recommend that you approve the attached li~ and authorize its consummation by the proper city <br />officials. The form of the lease was prepared by the City Attorney. <br /> <br />The lease- <br /> <br /> "THIS DEED OF LEASE, Made the first day of March, t93~, be- <br /> tween the Oity of Portsmouth, a municipal corporation of the State <br /> of Virginia, party of the first part, and George T. McLean Oompany <br /> Imcerporated, party of the second part. <br /> WITNESSETH, That the said par~yof the first part doth de, <br /> mise unto the said pa~y of the second part, from the first of <br /> March, 1934, for the term of one year thence ensuing, the land at <br /> ~he east end of South Street, east of~the land occupied by the <br /> t~acks cf the Seaboard Air Line Railway Company, yielding therefor <br /> during said term the said sum of twenty four ($~4.O0) Dollars per <br /> annum payable semi-annually at the end of each six months period. <br /> The said City of Portsmouth reserves unto itsel~ the right <br /> to terminate this lease at any time by giving to the said party of <br /> the second part thirty days w~itten notice of such intention, giv- <br /> en through its executive officer or legislative or other governing <br /> body, and until such notice is given this lease shall.renew itself <br /> from year to year upon the same terms a nd conditions. <br /> It is agreed between the parties hereto that the said City <br /> of Portsmouth does not warrant the title to the said land and does <br /> not covenant for the said lessee~s quiet enjoyment thereof. <br /> The said City e/ Portsmouth reserves unto itself the right <br /> to use the said land for the extension of its sewerage and drain- <br /> ag~ system with the right to install new pipes and change or re- <br /> locate any existing pipes. <br /> The said lessee covenants to pay the rent and taxes upon <br /> amy improvements which he may erect upon the said l~nd which are <br /> subject to taxes under the laws of the State, and that the said <br /> City of Portsmouth may re-enter for ~em(10) days default in the <br /> payment of rent, or for the breach of any covenant. <br /> <br />WITNESS THE FOLLOWING SIGNATURES AND SEALS: <br />City of Portsmouth <br /> <br />ATTEST: <br /> <br /> City Clerk. <br /> <br />By <br /> <br />President <br />Mayor of <br /> <br />of the Council an~ ex-officio <br />the City of Portsmouth,Virginia. <br /> <br />George T.McLean Company, Incorporated. <br /> <br />By¸ <br /> <br />"President. <br /> <br />ATTEST: <br /> <br />Secretary., <br /> <br /> Motion of Mr. Hutchins to concur in the Manager,s recommendation and that proper <br />officers be authorized to execute said lease, was adopted. <br /> <br />2nd - The Manager presented the following resolution: <br /> <br /> "BE IT RESOLVED by the Council of the Oity of Portsmouth <br />that, pending action by said Council and the State Corporation <br />Commission of Virginia on the proposal of Virginia Electric and. <br />Power eom?any to substitute motor bus service for the present <br /> <br /> <br />
