<br /> a then existing water main of not less than six inches in diameter..
<br /> (3) Portsmouth agrees to supply water to the County of Norfolk and the inhabi-
<br /> tants thereof in the locations in which street mains are now installed or may hereafter be in-
<br /> stalled under the provisions of this contract, at the same rates now or hereafter promulgated
<br /> by the COuncil of the C-ity of Portsmouth for like consumers within the City of Portsmouth, the
<br /> terms, conditions, rules and 'reguIhtions as to water service, connectioms, and laterals from
<br /> street mains t,ed~re_mis.es to..be ,the same..in the County of Norfolk as in the City of Portsmouth.
<br /> ~ ~ l, ormsmou~n whenever mm may open any of the streets or highways of the Coun-
<br /> ty of Norfolk for the purpose of laying, repairing or replacing the water system will restore
<br /> said streets as soon thereafter as practicable.
<br /> (5) Portsmouth agrees to cancel the amount charged on the books of the Water
<br /> Department for water supplied Norfolk County Jail to date of September 30th, 1933, and the
<br /> amount charged on the books of the Water Department for fire hydrant service in Oradock to
<br /> date of September 30, 1933.
<br /> (6) The Supervisors covenant and agree, during the period of this contract to
<br /> pay to the City of Portsmouth quarterly for the use of the fifty-nine fire hydrants herein re-
<br /> ferred to as connected with the water mains in Norfolk County now owned by the City of Ports-
<br /> mouth, and any additional fire hydrants installed on such mains at the request of the Super-
<br /> visors, at the rate of fifty ($55.OC) dollars each per annum. '
<br /> (7) The Supervisors hereby confirm in so far as they may legally do so, the
<br /> use by Portsmouth of the streets and highways of the County of No~folk for existing water mains
<br /> ariel for the maintenance and repair of same, and agree when requesting additional mains to be
<br /> laid by Portsmouth, to provide rights of way for such mains without expense to Portsmouth.
<br /> (8) The Supervisors agree to adopt such resolutions and ordinances as may be
<br /> necessary to enforce in the Oounty of Norfolk the same rules, regulations and ordinances as te
<br /> consumers service pipes,, water service and payment of water bills as are enforced in the City
<br /> of Portsmouth.
<br /> (9) The Supervisors will convey upon the execution of this contract to Ports -
<br /> mouth by good and satisfactory title all of the water mains, fire hydrants, valves, fittings,
<br /> appurtenances and water meters owned by the County of Norfolk in the City of Portsmouth and
<br /> in the Country of Norfolk, including rights of way in the streets and highways cf the County;
<br /> the service pipes ex~ending from the street mains to premises are not to be conveyed to Ports-
<br /> mouth, but will be the property ef the owners of the respective premises.
<br /> (lC) It is agreed between the parties hereto that the contract between the City
<br /> of Portsmouth and County of Norfolk for construction of a joint Municipal and County Building,
<br /> and the agreement if auy for the free supply of water to the County Jail, are hereby cancelled
<br /> as cf date September 30th, 1933.
<br /> (All) That the sixty-one fire hydrants now' in serviceable condition at ~radock in
<br /> said County of Norfolk will be continued in service without chazge for a period of ten years
<br /> from October let, 1933, and from and after October l, 1943 these fire hydrants or such of them
<br /> as -that Supervisors may at that date ~esire te continue in service, shall be paid for by the
<br /> Supervisor~ in quarterly payments at the same rate per annum and at the same periods as the
<br /> other fire hydrants herein referred to as connected with mains now owned by Portsmouth in the
<br /> County of Nerfol~k.
<br /> (12) The said City of Portsmouth further agrees that should the amount now
<br /> charged the cities of Portsmouth or Suffolk for rental of fire hydrants be hereafter reduced
<br />- during the ~erm of this contract, then the same rate of reduction shall be made for the fire
<br /> hydrants charged Norfolk County.
<br /> (13) The Supervisors agree to pay monthly for water furnished the County Jail
<br /> on and after October l, 1933, at the rates as mentioned in paragraph (3) ~above.
<br /> (14) It is further agreed between the parties ~o this contract that if at any
<br /> time any tax, assessment, levy or any form of license fees or other ta~es for any public pur-
<br /> poses shall be imposed upon any and all property, real, personal and m~xed of the water works
<br /> system of Portsmouth in the County of Norfolk, whether the same is collected by the County of
<br /> Norfolk er for the benefit of the County of Norfolk, the total fire hydrant rental herei~
<br /> agreed upon shall be increased by an amount equal to such tax, assessment or levy, and the
<br /> amoUnt of each such tax, assessment or levy shall be paid to Portsmouth as increased fire hy-
<br /> drant rental O~l~e date that any such tax, assessmen~ or levy may be payable by Portsmouth.
<br /> This contract shall be effective for a period of twenty years from October
<br /> let, 1933. -
<br /> IN WITNESS WHEREOF, The Oity of Portsmouth has caused these presents to be signed
<br /> by J.Alden Oast, President of its City Council and Ex-officio Mayor, and the corporate seal ef
<br /> said City to be affixed, attested bT L,C. Brins~n, its City Clerk, by due authority of a reso-
<br /> lution adopted by the said City Council on the ~ day of ... , 1934.
