At a regular meeting of the Oity Oouncil held August ltth, 1935, at 8:00 P.M.,

<br /> Minutes of regular meeting held JUly 2~h were road and approved.
<br /> The following communications from the Oity Manager were read:

<br /> OLINE AND OIL STATIONS AND STORAGE TANKS, OR OTHER PLAOES WHERE

<br /> I consider this ordinance necessary as a protection to the pumping sta-
<br />tion and water supply of the0it y and have been unable to find where it will work a hardship on
<br />anyone.~
<br /> On motion of Mr. Hutchins, said ordinance was placed on first reading.
<br /> 2nd - "I find that the funds received from the sale of lots and for the perpe-
<br />tual u~keep of lots i~ the cemeteries have not been handled as provided in ordinance adopted
<br />June 16th, 1922, provmding for the sale of lots and regulating the management and control of
<br />the Olive Branch 0emeterM, and amendment to this ordinance, adopte~ October ~Oth, ~922,.apd
<br />ordinance adopted June l~th, 1922, pr?v~di~g ~or perpetual care and upkeep om cemetery £oms,
<br />Amendment to ordinance adopted June lbth, 1922 provmdes that ~all sums received from the sale
<br />of lots in Olive Branch Oemetery shall be paid into a cemetery maintenance f~uud until this
<br />fund shall equal $100,000.00. Funds thus paid in shall be handled by the Sinking Fund Oommis-
<br />sion of the 0ity of Portsmouth - also that this maintenance fund shall be held intact, shall
<br />not be borrowed from for any purpose whatever, and the income therefrom shall be devoted
<br />solely to the maintenance of the Olive B2anoh Oezetery. After the maintenance fund equals
<br />$100,O00.00, all income from the sale of lots shall be paid into the Sinking Fund of the Oity
<br />and shall be eontrolled, invested and~used for the redemption of some outstanding indebtedness
<br />of the Oity of Portsmouth, in the same manner and subject to the same conditions as ~he Sink-
<br />ing Fund created for the redemption o~ said debt is required to be invested, controlled amd
<br />used.!
<br /> Ordinance adopted June 16th, 1~22, providing for perpetual care and~up-
<br /> keep of cemetery lots l~revides that ,the owner or owners of a lot or section in any cemetery
<br /> owned by the Oity, desiring to place his or their lot or section ~nda= perpetual care of the
<br /> Oity z~ay pay ~nto th~ treasury of the Oity a sum equal to twenty-~mve cents for each square
<br /> ~oot o£ area contained in said lot or section, but in no ease shall such payment be less than
<br /> the sum of One Hundred Dollars, in consideration of which payment, the Oity assumes the per-
<br /> petnal care of the lot or section'. This ordinance ~u~er.provldeS that''all sums so p~id
<br /> into the treasury shall be.placed to the credit of the Smnkmng Fund 0ommisSioners and by them
<br /> invested, controlled and used for the redemption of some omtstandin~ indebtedness of the Oity,
<br /> in the same manner and subject to the same'conditions ss the Sinking Fund created for the re-
<br /> demption of the said debt is re~ired to be invested, con~lled and used.
<br /> The funds collected to date from these-sources have been deposited in
<br /> the banks in a separate account, styled ,~emetery Fund". These fu~nds draw the usual rate of
<br /> interest allowed by the bs~ks for savings accounts and the interest on the funds has been
<br /> transferred to the General Fund and used for maintenance of the cemeteries. As of July 3let,
<br /> 1934, there was on hand in the 0emetery Fund $$6,$05~, which is all that has been collected,
<br /> except the amounts authorized by you to be used from this-fund for improvements to the ceme-
<br /> teries.
<br /> The provisions provided in the effective ordinances governing the main-
<br /> tenance and perpetual ca~e of cemeteries, appears satisfactory; therefore, I recommend that
<br /> these funds be turned over to the Sinking Fund Oemmission to be handle~ as provided in the or-
<br /> dinances mentioned herein goverhing the collection and handling of funds received f~om the
<br /> sale of cemetery property."

<br /> The communication of the City Manager concerning the matte~ of Police O~£icer
<br />which was laid on table at last meeting, was taken up and read.
<br />
<br /> Motion of Mr. Brooks that ~he 0ity Manager be directed to offer Mr. Peavy his
<br />salary for time lost, of approximately sixty days at $$.$6 per day, without acknowledging any
<br />liability to the 0ity en account of his injuries and without prejudice to the rights of the
<br />Oity and upon payment of same to receive from Mr. Peary a release in full and acknowledging no
<br />liability on part o£ ~he Oity, was adopted.
