<br /> This day came S.E. Wiley, P. Co Hut~hins, and John H. Boatwright, three of the
<br /> Commissioners of Election appointed by the Electoral Board of the City of Portsmouth, Virginia
<br /> to canvas the ballots and election returns of the election held in the City of Portsmouth, Vir-
<br /> ginia, on the 12th day of June, 1928, pursuant to an order of this court entered on the 19th-
<br /> day o~ Nay, 1928, for determining the question whether $500,000d of bonds shall be issued in
<br />conformity with an
<br /> ordinance of the 0ity of Portsmouth, adopted by the 0ouncil cf said City on
<br />the 8th day of May, 1928, the object for the issuance bf said bonds being to "cay certain 'out-
<br />standing indebtedness incurred in the purchase of a portion of the City system of water works
<br />from the United States of America, and to pay the costs of extensions, betterments, and im -
<br />provements to said water works system", and presented to the court their certificate of the
<br />qualified votes cast at said election as follows: For bond issue were cast two thousand and
<br />fifty-four (2054) votes, Against bond issue we=e cast eleven hundred and sixty four (1164)
<br />votes. On consideration whereof, it is ordered that the said certificate of election returns
<br />~e filed in the Clerk's office of this ~
<br /> _ ~, and that it is here entered of record as the r~-
<br />s~lt of sai~ election that a majority of said qualified votes were cast "For Bond Issue", and
<br />it is further ordered that the Clerk of this Court do forthwith certify s copy of this order
<br />~o the ~ooncil of the City c~ Portsmouth, who shall be thereupon fully authorized and empow-
<br />ered to pre, are, sell, and negotiate said bonds upon the faith, credit,~d property of said
<br />municipality in the amount as authorized.

<br /> Early in January we~wrote to you requesting a reduction in our license tax for
<br />the fiscal year 193g, in view of the meagre taxable receipts we had heretofore obtained at
<br />Portsmouth. Temporarily, we withheld payment of the tax until receipt of notice of the action
<br />taken by you thereupon~
<br /> Sometime after the due date of the tax, demand was made upon us by the O~ y Col-
<br />lector. ~n compliance ~he~ewith we immediately made remittance of the rate'formerly obtained,
<br />when he advised us that you had declined to grant favorable consideration to our application.
<br />As payment was made beyond the period of grace usually allowed, a penalty of 5~ technically
<br />accrued. The Collector is now asking us to make payment for this additional amount.
<br /> As the action of the company was neither arbitrary nor capricious we feel that
<br />it is most inequitable to charge us with this penalty. Our failure to remit was accounted for
<br />solely by our ~elianoe on the fact that you had not yet been able to give o6nsideration to ~
<br />request for an adjustment. Under the circumstances, therefore, we feel certain that yo~ will
<br />share our view that cancellation of this additional charge is~the only fair relief that can
<br />now be granted, and that hence, you will instruct 0ity 0olleotor to withdraw his request for
<br />the payment of this item. ~
