<br /> The building on the property 16 Middle street is vacant and untenantable, and
<br />in a very bad condition, We should advise letting the property be sold to Mr. Bilisoly for
<br />$600,00. However, Er. Bilisoly states that he is not interested unlsss he cs~u obtain posses-
<br />sion immediately, and it seems doubtful that he will wait for a sale in a chancery suit. It
<br />has not been the policy of the City OounciI to compromise taxes and we are making no recommen-
<br />dation in the matter.
<br /> The building 78 and 20 Middle street is a double house, one end of which is oc-
<br />~apied by the family of the late W.T. Eastwood and the other end, a short time ago was vacant.
<br />This property is in fair condition.
<br /> The building on the Scott Street property is vacant and in our opinion is of no
<br />Value. If this property is sold we believe it will have to be ou~chased by the City and the
<br />building razed. The landis on the edge of the drain leading int~ Gander Creek ~ud in our opin-
<br />ion unsaleable.
<br /> The property on Washington Street is located along the drain near Harrison St.,
<br /> and is in a very bad state of repairs. We understand that little or no rent is received from
<br /> the same. A chancery suit is now pending for the sale of the property 308 North Street
<br /> and an order of sale bas been entered. ILr. Clyde W. 0ooper, an Attorney, who is representing
<br /> the Eastwood heirs, thought that he had a purchaser for this pzeperty, but has been unable to
<br /> consummate the sale. This property can be sold at public auction, but there is some .question
<br /> about obtaining a purchaser. The building is in bad condition and some doubt the advisability
<br /> of remodeling the same.
<br /> Taxes are als~ due in the name of M.D. Eastwood Estate and others, on property
<br /> ll5-11? High Street in the amount of $2400.22, for the years 1927-1933 inclusive. Also a
<br /> charge of ~ll~.OO has been placed against the property ~or razing the building. Mr. Norman
<br /> R. Hamilton has purchased this property but has refused to pay the taxes owing ~to the charge
<br /> of razing the building. He contends that he obtained a statement from the City Collector's
<br /> office which did not contain the $11g. O0 charge and that he settled with the Eastwood heirs
<br /> on the strength of this statement. He puzormsed the property shortly after the building was
<br /> razed and before the charge was made and sent to the City Oollectoro Consequently the state-
<br /> ment did not contain the charge. .~owever, the fact that the 0harge would be placed against
<br /> the property had been previously decided by the Council and had been published in the newspa-
<br /> per. How far Mr. Hamilton should have known the same, is a euestion. Mr. Hamilton, on the
<br /> other hand, had the statement verifie~ by his .son after he h~d obtained the same from his law-
<br /> yer.
<br /> It aopears that the taxes due on ~ll of the. property belonging to the Eastwood
<br /> Estate, with the p~ssible exception of proper~y 16-18 Mid~ls Street, amounts to more than the
<br /> value of the property, and we recommend that the City Attorney be directed to institute a
<br /> chancery suit for the sale of all the property, using his discretion as to the time of selling
<br /> 16-18 Middle Street after having determined whether sufficient rent~ can be obtained from this
<br /> latter property to pay the taxes.
