At a reguI~r meeting of the City Council held September 25th, 1934, at 8:00
P.M., there Were present:

Vernon A. B~ooks, Leslie T. Fox, W.R. Hutchins, B.B. Moore, J. Alden Oast,
H.F. ~arrish, J.R. Stewart, the Oity Manager.

Minut'es of regulsm meeting held September llth were read and ap~uroved.

The following communications from the City Manager were read:
1st - "The Oity of Portsmouth has received a d~ed from the United States, under
date of September llth, 193~, for all of the property which the United States owned in connec-
tion with the Water Works System. This deed will be sent to the Nansemond County Olerk's Of -
lice, in the next few d'ays, for recordation.
At the time the Oity of Norfolk purchased from the City of Portsmouth the
Water Works System, located in Berkley and Sonth Norfotk,'there was h61d in escrow, deposited
in the several banks in the City of Portsmouth, the sum of $25,000.00. This amount was to be
held until the City of Portsmouth acquired title from the United States of America for the wa-
ter meters attached to the Berkley and South Norfolk system. Since tha~ time the State Bank of
Portsmouth has failed, and t~e sum of $4,166.67 was released to the City of Portsmouth and the
remaining sum of $20,~).33 ms now held in the follewing banks of Portsmouth, as follows:

American National Bank $ 12,500.00
Merchants & Farmers Bank 4,I66.66
Citizens Trust Company 4,166.6y
I have t~ken this matter up with Mr. T.P. Thompson, the City Manager ~ Norfolk, and have re-
quested him to have the City Council of Norfolk release the money which is held in escrow.
In the deed which the City of Portsmouth gave to the, 0ity ef Norfolk, it
was agreed that the above money was to be r~leased as soon as title to the 1~1 water meters
was conveyed to the City of Norfolk. The City of Portsmouth is now in a position tc convey
title to the meters and I recommemd that the City Attorney prepare a confirmation deed, and
that the proper officers of the City Council be authorized to sig~ the deed conveying title
to the me,ers to the City of Nor~l k. I am informed that as soo~ as this deed is received
thatthe City of Norfolk will release the money in escrow."

The followimg resolution was offered by N~. Stewart and duly seconded:

~Be it resolved that the recommendations set forth in the foregoing letter of
the City Manager, be adopted and that the Oity Attorney be instructed to prepare and deliver
a deed to the City of Norfolk conveying title to the 165t meters and their settings mentioned
in said letter, amd that the proper officers of the City be authorized to execute the same,,
