Brooks, <br />Eayor of City of Portsmouth, <br />Portsmouth, Virginia. <br /> <br />Dear Sir: <br /> <br /> In reference to the matter of waiving penalties and interest in delinquent <br />taxes, I find that the Act of the General Assembly of Vzrgznza oermzt~ng the waive2 of pen- <br />alties and interest was oassed on Naroh 7, 193~ and became effective immediately under ~n <br />emergency clause. Under the. terms of the Act the Oity had a right to waive the penalties <br />and {nterest for a period of 120 days from its effective date. Hence the period allowed by <br />the Statute expired last July, and the City has not at this t~ne the right to put such a <br />orovision into effect. <br /> <br />Yours very truly, <br /> <br />R.0.
