i81 <br /> <br />On motion referred to the Oity Attorney. <br /> <br />The following letter was read: <br /> <br /> "1~. John Ismuet Thomas h~s received from the Oo!lector a statement of taxes <br />due £rom him on ~srsonal property a~ Executor of the estate of Cornelius Thomas, the total <br />amount of the assessment being $900,00, the amount of the bill bding $23.85. <br /> Er. Cornelius Thomas died on September 6th of last year and his son settlSd <br />the estate with the Commissioner of Accounts and'reported such settlements to the Examiner <br />of Records prior to January let. When the Examiner sent me his forms for making returns, I <br />notified him that the estate had been settled and that all taxes due had been oaid. <br /> Er. Lemuel Thomas made a personal return for this year and retu~rn for taxation <br />to the City on personal property, making the return through Er. Hutchins Oo~nissioner of <br />Revenue. On this return he has been assessed, and the taxes £or 1934 on'personal property <br />will be paid by him. All the personal prooerty of Cornelius Thomas was left to his son and <br />the tax assessed against him as an individual is on that property. <br /> E ' <br /> ~tr. Ashburn, the xamzner of Records, also made returns ~o the State an~, as <br />soon as I £ound it out, ~ tobk it up wi-th the State Tax Commissioner with the result that he <br />was exonerated from the payment of taxes to the State as Executor. <br /> I am therefore in his behalf requesting you to relieve him of ~he tax as Exe- <br />cutor of the estate of his father, as Should he have to cay this tax he would be doubly taxed <br />on the same property. <br /> <br /> Respectfully submitted, <br /> <br /> J. Lewis Thomas, <br /> For j. Lemuel Thomas." <br /> <br />On motion refferred to-the Oity. Attorney. <br /> <br />The following Order of Oourt was read: <br /> <br />"VIRGINIA: <br /> <br /> IN THE 0IROUIT COURT OF THE 0ITY OF PORTS~OUTH ON THE 9th DAY OF NOVEEB~,I934. <br />F.J.Smith, trading as~Portsmouth Casket Co~oany ] <br /> V. <br /> The City of Portsmouth <br /> <br /> THIS CAUSE came on this day to be heard upon the oetition filed herein and upon <br /> the evidence offered by the parties, and was argued by counsel, ~he cause being defended by <br /> the Oity Attorney of the Oity of Portsmouth. - <br /> AND IT APPEARING TO THE COURT that the petitioner is a manufacturing merchant <br />doing business in the 0ity of Portsmouth, Virginia, subject, under Section 188 of the Tax 0ode <br />to s tax on capital only, and not subject to any license tax assessed by either the State or <br />0ity; and that the exaction by the Oity of Portsmouth of license taxes from the petitioner for <br />the years 1933 and 193~ was improper and in violation of the law and that he has been assessed <br />by the State of Virginia on his o~pital invested. <br /> IT IS ADJUDGED, ORDERED, AND DEGREED THA~ TME CITY OF PORT$HOUTH do pay over <br />to the petitioner the sum of Fifty Eight Dollars and Eighty Oents, that being the totai amount <br />of the license t~xese~roneously assessed and collected by the Oity of Portsmouth for the <br />years 1933 and t9~4. <br /> <br />A 00PY, <br /> <br />TESTE: KENNETH A BAIN, JR., OLERE. <br /> BY D.V. Major - <br /> <br />Motion of Mr. Oast to appropriate $58.80 to make said refund, was adopted. <br />The following letter was read: <br /> <br /> "I am offering you an o-m~nance that will remove all immorality around For <br />Hire Oars and Taxis. <br /> By allowing not more than two for hire oars to park in any cae blocs of the <br />C}ty of which there will be no discriminations.+ used against anybody. And will allow the 0ity to <br />get revenue from as many as see ~ to buy license. This ordinance has been operating very <br />satisfactorily in the Oity of Jac<' Sonv~lle,' Fla., for the past n~umber of years. <br /> Respectfully submitted by a Tax Paying Oitizen. <br /> <br /> J.A. Darden, 701FloridaAve., Oity." <br /> Privilege of the floor was granted Ar. Darden, who complained about his <br />treatment in trying to ooerate a ~for-hire car". <br /> <br /> On motion, same was referred to the 0ity Manager for investigation and report. <br /> <br /> Letter was received from Portsmouth Eetal Trades 0ouncil, Federal Employers <br />Local, B~otherhood Railway Carmen, International Association of Machinists, who endorsed the <br />action of the Central Labor Union for free school books. <br /> <br /> <br />
