<br /> Minutes of regular meeting held August 27th and special meetings of August
<br />28th and September 3rd, were read and approved.
<br />
<br />The following communication from theOity Attorney was read:
<br />
<br /> "At your me,ting held on August 16th, 1935, you referred to me ~ letter from
<br />Hofheimer's Inc., requesting a refusd Sf $10.55, penalty paid on Oity license taxes for the
<br />year 1935.
<br /> I am informed in the City Collector's office that someti~hefore the penalty
<br />was added, probably during the mont~ of May, a colored man brought a check in the office pay-
<br />able to Mary A. Hudgins, City Treasurer, ~ud stated he desired to pay the Hofheimer License
<br />tax. The Olerk informed him the check was payable to the wrong party and also Mrs. Hudgins'
<br />name was not correct, and she told him to take it back and get a check payable to Mr. A.E.
<br />Parker, City Collector. Shortly thereafter, the Manager of the local store came in with the
<br />check and was told the same thing, Nothing was further heard about the m~tter until after
<br />the penalty date passed and Mr. Walton, the former License Inspector, notified the Manager
<br />that he must obtain a license. The Manager then paid the license with the.penalty. I under -
<br />s~and that Hofheimer~s firm contends that after the first check was returned ~hat they imme -
<br />diately sent another check by a colored man, payable to Mr. Parker. Mr. Parker .has no know -
<br />ledge of this c~eck; it never reached him an~ has not been cashed. Under the.circ'~mstances,
<br />I do not see where theemployees of the City were at fault and I do not recommend a refund."

<br />Motion of Mr. Oast to refund the penalty of $10.55 was adopted.
<br />
