The house is vacaUt, and being gradually demolished. Hatton requesting a refund o_ ~39o75 paid for.taxes for the years <br />1932, 1933 and 193k on a building on a lot of land~ on the east ~ide of Washington <br /> The land in question is assess.ed as a lot 100 by 260 feet on the east <br /> side of Washington St., ~.d had a building v~2ue thereon of $500. It lies at the east end <br /> ~ p ~ on <br />of Carroll St., 'and adjoins the Harbor View Apartment o~o sr~v the south. At the s~e <br />time the Harbor View Apar~ment was built there were two delapidated bhildings on the l~ud, <br />and the building Ineoec~or and the Chief of the Bureau of Fire Protection attempted to have <br />~he e~me removed. They were torn down by people for fire-wood and no permit was obta_ne~ to <br />wreck the same. As far as I have been able to ascertain they were removed during the year <br />1931, and ~rs. Hatton ~pears to be entitled ~o a refund of $13~25 for .each of the above <br />years, or a tot~ of $39-75, which I recommend.~ <br /> Motion of Mr. Oast to concur in the City Attorney's .recommendation was adopted. <br /> 2nd - "In agreement entered into between the City and the Virginia Electric <br /> Power Company~ in connection with the abandonment of the ~tree~ railway system ~n Portsmouth, <br /> the Power Comoany agreed to convey to the City ~.l rights it had in the streets in the City, <br /> the right of ~ay through Brighton of the Cradock line, and two lots in Park View needed for <br /> the widening of Armstrong St. I prepared a deed describing the property end requested that <br /> the same be signed. The Power Oomp~ay added the last paragraph as shown in ~he attached deed, <br /> ~nd omitted certain property which was not u~ed for street purposes. I respectfully request <br /> tb~t the a~tached resolution be oaseed and the City accept the deed. The Power Company is <br /> this time preparing to release ail outstanding mortgages ~ad ~o place a new mortgage on its <br /> property on November let, and therefore it is necessary that the matter be acted on at this <br /> meeting.~ <br /> <br /> On motion of Mr. Stewart, the following resolution was adopted, and by the <br /> following vote: <br /> <br /> Ayes: Brooks, Fox, Hutehins, ~oore, Cast, Stewart. <br /> Nays: None. <br /> <br />"RESOLUTION <br /> <br /> "A RESOLUTION To approve the form of the attached <br />deed by. which Virginia Electric & Power Company~ proposes to con- <br />vey certain real estate to the City of Portsmouth; ~o accept <br />said conveyance upon the terms and conditions therein stated and <br />to authorize and direct the execution thereof on behalf cf the <br />CiZy. <br /> <br /> W~EPJEAS~ by an agreement, dated ~ay 10th, 1935, between the City of Ports- <br />mouth and Virginia Electric and Power Company, the City ooRsented to the discontinuance and <br />abandonmen~ by said Company of its entire street railway system ~n said City; and <br /> WHEreAS: the said agreement provided that said Company <br /> "doth hereby gran~ and convey to the City al! of <br /> its right, title a~d interest in and to any private rights- <br /> of-way in said City mow used by it in the operation bf said <br /> stree~ railway system; and the City doth hereby accept said <br /> g~ants and-~onveyances. Provided, however~ that the Power <br /> Company doth hereby -reserve the right to use all such pri- <br /> vate rig~ts-o'f-way for the construction, maintenance and <br /> operation of i~s electric light ~nd power system, to which <br /> reservation the City doth hereby assent."; <br /> <br />and <br /> <br />WHEREAS, ~he City requested a more definite descr~ptio~ of <br />said rights-of-way and the conveyance of certain additional <br />land which was purchased by the Company for ri~nt-of-way <br />purposes~ but not lying within the lines of the strips <br />tually used for rights-of-way, and in response to which re- <br />quests the Company has offered to make a conveyance to the City <br />in the form of the deed hereto attached, as a part hereof; <br /> <br />THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH: <br /> <br /> <br />
