At a regular meeting of She City ~ounci!, held May 12th, 1936, there were present: Vernon A. Bro~ks, Leslie T. Fox, J. T. Hanvey, W. R. Hutchins, at $.B. Moore, J. Alden Oast, J~R. Stewart~ ~ity ~anager. Minutes of regular meeting, hel¢ April 28th, were read and approved. The Special Committee on Traction Company Taxes, reported as follows: "Tour undersigned committee, appointed November 26th, 1935, to go into the that, Naupin franchise of the Traction Company, dated August 19th, 19lO, begs permission to report, with your sanction, we have employed Messrs. Smith R. Brittin~ham, Jr., and William G. to go into the franchise, from a legal aspeoto The Attorneys report: 1st - The agreement or franchise in question is unenforceable, from a legal sta~dpoint. 2nd - The Traction Company has no v~lid franchise with the City of Portsmouth, and is occupying the streets of the City, with ~ts poles and paraphenalia illegally. 3rd - The Traction Company being Ln possession of the streets should be made to pay the City of Portsmouth, for such oecupanoy dr be forced to vacate the streets. ~e therefore recommend that ~he consultant a~torney, Mr. Wm. Hanvey.a Motion of Mr. Stewart to receive said report, and concur in the recommendation contained therein, was adopted. The following communications from the City Manager were read: 1st - The Mahager presented the following letter from the State Highway De - partment, which was, on motion, filed: ~Mro E.Bo Hawks, City Manager, Portsmouth,Va. Dear Sir: _Replying to yours of the 5th, relative to Pro- Ject ~PMS-lO36-D, construction of High Street in Portsmouth, wish to advise that this has just come from the Bureau ef Public Roads approved. This will be advertised shortly. By, Yours very truly, C.S. Mullen, Chief Engineer, A.H. Pettigrew, Sr.A?sistant Engr." 2nd - "I am presenting herewi%h an ordinance authorizing the issuance of $13,000. cf fire ~paratus bonds, in lieu of a similar ordinance, for like amount, adopted January 28~h, 1936, %he difference being tha~ ~he former ordinance provides serial bonds, with $1,000. maturing in 1937 and $1,O00. each year thereafter, through thirteen years, at a rate ef interest of ~%, while the proposed ordinance provides for serial bonds, with $2,000. matur- ing in 19%1 and $2,000. each succeeding year through seven years, with $1,O00. ma~uring the last year, 19~?, with interest at ~%. Also, presented herewith is an ordinance repealing the original ordi nance of January 28th, 1936. I recommend that these ordinances be adopted." Motion of Mr. Hutchins to place the following ordinances on first reading, was adopted: "AN ORDINANCE AUTHORIZING THE IS~J~NCE OF THIRTEEN THOUSAND DOLLARS OF BONDS OF THE CITY OF PORTSMOUTH, VIRGINIA, TO BE KNOWN AS FIRE APPA~RATUS BONDS FOR THE PURPOSE OF PURCHASING FIRE ENGINES AND OTHER NECESSARY FIRE APPARATUS F~R THE CITY, MAKING PROVISION FOR THE FORM OF SAID BONDS AND FOR THE PAY- MENT THEREOF" and #A~ ORDINANCE REPEALING AN ORDINANCE ENTITLED 'AN ORDINANOE AUTHORIZING THE ISSUANCEOF THIRTEEN THOUSAND DOLLARS OF BONDS OF THE CITY OF PORTSMOUTH, VIRGINIA, TO BE KNOWN AS FIRE A~oPARATUS BONDS FOR THE PURPOSE OF P~CHASING FIRE EN- GIN]ES AND OTHER NECESSARY FIRE APPARATUS FOR THE CITY, MAK- ING PROVISION FOR THE FORM OF SAID BONDS AND FOR THE PAY~E~tT THEREOF~ ADOPTED BY THE COUNCIL OP THE CITY OF PORTSMOUTH, ON JANUARY ~1936".
