<br />Minutes of regular meeting, hel¢ April 28th, were read and approved.
<br />The Special Committee on Traction Company Taxes, reported as follows:
<br /> "Tour undersigned committee, appointed November 26th, 1935, to go into the

<br />franchise of the Traction Company, dated August 19th, 19lO, begs permission to report,
<br />with your sanction, we have employed Messrs. Smith R. Brittin~ham, Jr., and William G.
<br />to go into the franchise, from a legal aspeoto
<br /> The Attorneys report:
<br /> 1st - The agreement or franchise in question is unenforceable,
<br /> from a legal sta~dpoint.
<br /> 2nd - The Traction Company has no v~lid franchise with the City
<br /> of Portsmouth, and is occupying the streets of the City,
<br /> with ~ts poles and paraphenalia illegally.
<br /> 3rd - The Traction Company being Ln possession of the streets
<br /> should be made to pay the City of Portsmouth, for such
<br /> oecupanoy dr be forced to vacate the streets.
<br />~e therefore recommend that ~he consultant a~torney, Mr. Wm. G. Maupin, be
<br />further ret~i'n~d and instructed to collect from the Traction Company, such monies as are due.

<br />$13,000. cf fire ~paratus bonds, in lieu of a similar ordinance, for like amount, adopted
<br />January 28~h, 1936, %he difference being tha~ ~he former ordinance provides serial bonds, with
<br />$1,000. maturing in 1937 and $1,O00. each year thereafter, through thirteen years, at a rate
<br />ef interest of ~%, while the proposed ordinance provides for serial bonds, with $2,000. matur-
<br />ing in 19%1 and $2,000. each succeeding year through seven years, with $1,O00. ma~uring the
<br />last year, 19~?, with interest at ~%.
<br /> Also, presented herewith is an ordinance repealing the original ordi
<br />nance of January 28th, 1936.
<br /> I recommend that these ordinances be adopted."
