<br /> This is an opportunity to acquire mu approved, modern Armory~ at a cost of
<br />$60,000., with no cash outlay by the City, beyond that to be received from the insurance,
<br />and I recommend that the Co-~qcil approve the project and that the accompanying resolutions be
<br />adopted~~-

<br /> Motion of Mr. Hutchins to c oncu~ in the Manager's recommendation and to place
<br />an appropriation of $8,000. on first reading.

<br /> On motion of Mr. Hutchins, the following resolution, offered in connection with
<br />the above, was adopted:
<br />
<br /> ,WHEREA$, the Council of the City of Portsmouth is desirous of constructing
<br /> an Armory in the City of portsmouth, in which two units of the Field Artillery of
<br /> the Virginia National Guard may be housed and trained; and
<br /> Wt{F~MEAS, it appears that the said A~mory may be constructed upon the City
<br /> of Portsmouth furnishing the necessary land, the sum of Eight Thguss~d Dollars
<br /> in cash~ and salvaged material from the present Armory building of an estimated
<br /> value of Four Thousand Dollars; which together with the sum of Twelve Thousand
<br /> Dollars which may be obtained from the Armory Commission of Virginia mud Certain
<br /> assistance from the Federal Works Progress Administration will be sufficient to
<br /> co~lete said project.
<br /> NOW~ THEREFORE, Be it resolved by the Council of the City of Portsmouth,
<br /> Virginia,-t~hat it will construct ~u Armory in said City of Portsmouth, Virginia,
<br /> that it will construct an Armory in said City, upon the following eondltions:
<br /> (1) T~t the City of Portsmouth will furnish the deoessary land, and
<br /> the sum of eighZ thousand dollars in cash, and salvaged material from the pres-
<br /> ent Armo~' Building of an estimated value of Four Thous~ud Dollars;
<br /> (2) That plans for the said A~nory sb~ll be approved by the
<br /> Co~mission of Virginia, the State Art Commission and the Council of the City of
<br /> P~rtsmouth;
<br /> (3) The entire cost of said Armory, including the real estate ~pon
<br /> which the same mhall be constructed, in excess of [A~ the amount to be contri -
<br /> buted by the Armory Commission of Virginia and (B) $~6,000.00 to be furnished by
<br /> the Federal Works Progress Administration, shall be ~opropriated or provided by
<br /> ~ the Council of the said City of Portsmouth, not, however, in excess of the items
<br /> in paragraoh (I) above; ~ .
<br /> -(h) The said Armory shall be used for the tra~nmng'of the National
<br /> Guard and for such other purposes not tnooncistent with law, as shall be agreed
<br /> upon by the Council and the Armory Commission of Virginia pursuant to the provi-
<br /> sions of Chapter
<br /> 3,~ of the Acts of theGeneral Assembly of Virginia, !932, and
<br /> amendments thereto:
<br /> (5) Title to the said Armory, including the real estate upon which
<br /> it is constructed~ shall, upon completion or when the work thereon is otherwise
<br /> terminated, be vested in the Commonwealth of Virginia and-the City of Portsmouth
<br /> in proportion in which the mmount of money contributed by the Armory Commissicn
<br /> of-Virginia bears to the total costs of said Armory, including the purchase
<br /> price or value of the land and ~he salvaged materials furnished by the City of
<br /> Portsmouth, and the said City shall cause a~sufficient'deed Zo be executed to
<br /> convey to said Commonwealth its ~&udivided interesZ in.said property;
<br /> (6) The cost of ell repairs, maintenance, insurance, operation and
<br /> care on, in and about the said Ar~ory shall be borne by the City of Portsmouth;
<br /> (y) The City of Portsmouth shall keep the said Armory insured at
<br /> its expense, and shall indemnify and save harmless the C~mmonwealth of
<br /> and the Armory Commission o~ Virginia from any and all loss resulting from or
<br /> arising out of any mud al! accidents and injuries to pers~n~ and prope~t~ in ~ny
<br /> way co~uected ~ith or resulting from the construction, use~ operation or occu
<br /> pmucy of the said Armory, so far as the same relates to the ownership cr main
<br /> tensm, ce of said A~mory, but not to accidents and injuries due to causes other
<br /> than the construction and maintenance of the building;
<br /> (8) Th~ money to be 'contributed by the Armory Commission of Virginia
<br /> shall be paid at such time or times, sm.d in such mariner as shall be agreed upon
<br /> by the Cotuucil of the City of Portsmouth and the A~ory Commission of Virginia;
<br /> (9) It is understood that all deeds, contracts and other instruments
<br /> pertaining to the conditions herein set forth shall be subject to ~oproval by
<br /> the A~to. ney Ge..e~l of V~g~nia~
<br /> (10) Before the terms of this resolution sbts. ll become effective, the
<br /> terms and conditions herein set forth shall be accepted by the A_rmory Commission
<br /> of Virginia."
