Brinson, <br />City Clerk, <br />portsmouth, Va. <br /> <br />Dear Mr. Brinson: <br /> <br /> Herewith for records of your Council, certified copy of admin- <br />istrative order of the Board, dated June 12, 1936, governing the conduct <br />of business of persons holding licenses to sell alcoholic beverages in the <br />City of Portsmouth, Virginia, which becomes effective June 20, 1936. <br /> You will not? that in the matter of soecial cloeLu$ hours, the <br />Board has acted in accoraance with resolution of ~une 9th, 1936, of your <br />legislative body, except that no prohibition has been placed against the <br />sale ef wine and beer on the Sabbath. <br /> As Mr. E.B. McLaughlin, Secretary." <br /> <br />Administrative Order of the Board - <br /> <br /> IICOMMONWEALTH OF VIP~INIA <br />DEPARTMENT OF .ALCOHOLIC BEVERAGE CONTROL <br />VIRGINIA ALCOHOLIC BEVERAGE CONTROL BOARD <br /> <br /> RICHMOND <br />June 12, 1936. <br /> <br />in Re: Administrative Order Governing the Conduct of Business <br /> of Persons Holding Licenses to Sell Alcoholic Beverages <br /> Underthe Alcoholic Beverage Control Act in the City of <br /> Portsmouth, VirgLula <br /> <br /> WHEREAS, at a meeting of the 0ouncil of the City of Portsmouth,_ <br />Virginia, held on April 14, 1936, there was adopted a resolution re <br />questing the Virginia Alcoholic Beverage Control Board "to close the <br />beer parlors in Portsmouth at l:00 A.M. on week nights and all day <br />Sundays~; and <br /> WHEREAS, the Commonwealth, s Attorney of the City of Portsmouth <br />on April 21, 1936, requested the Board to close "a!l beer parlors <br />all day Sunday and at l:O0 A.M. every night except Saturday smd on <br />Saturday close them at 12:00 o~clock, midnight"; and <br /> WHEREAS, the Chief of Police of the City of Portsmouth on April <br />24, 1936, requested the Board to see that "the sale of wine and beer <br />be stopped a~ l:O0 A.M. until 6:00 A.M. during the week and from <br />12:00 M, midnight, Saturdays until 6:00 A.M. Monday"; and <br /> WHEREAS, an investigation by the Board has caused it to believe <br />that it is proper at this time to restrict the hours during ~hich <br />persons licensed to sell alcoholic beverages under the Alcoholic <br />Beverage Control Act, in the City of Portsmouth, Virginia~ may sell <br />such beverages, the Board on May 9, 1936, through its Secretary did <br />write the City Manager of the City of Portsmouth asking for a clar- <br />ification of the term "beer parlor" and advising tha~ it is its <br />opinion that the extent of its action should be limited to prohibit <br />the sale of wine and beer after l:O0 ACM., and that sales on the <br />Sabbath may be controlled under the general law of ~he State without <br />recourse to the B~d; and <br /> WHEREAS,- at a meeting of the Council of the City of Portsmouth, <br />on June 9, 1936, there was adopted a resolution reqmesttng the Virgi- <br />nia Alcoholic Beverage Control Board "to prohibit the sale of wine <br />and beer at all places for which a license is issued in portsmouth <br />from l:O0 A.M. to 6~00 A.M., on week days and from 12:00 P.M. Satur- <br />day to 6:00 A.M.
