Virginia will, upon the conditions hereinafter set forth, contribute
<br />to the City of Portsmouth, from thefunds appropriated for the erection
<br />of armories, to be expended under the direction of the said Commission,
<br />the sum of Twelve Thousand ($12,000.00) Dollars, to assist in the con~
<br />struction of an armory in the said City of Portsmouth;
<br />
<br /> (1) The Council of the City of Portsmouth shall agree to con-
<br />struct a standar~armory in the said City; and furnish a suitable lot
<br />upon which it is erected.
<br /> (2) The plans for the said armory shall be approved by the
<br />mory Commission of Virginia, the State Art Commission and ths Council
<br />of the City of Portsmouth;
<br /> (3) The entire cost of said Armory, including the real estate
<br />upon which the same shall be constructed, in excess of the amount to be
<br />contributed by the Armory Commission of Virginia, shall be appropriated,
<br />provided or secured by the Council of the said City of port'smouth; ei-
<br />ther from private, m~nicipal or Federal funds.
<br /> (~) The saia armory shall be used for the training of the Nat~
<br />ional Guard and for such other purposes not inconsistent with law, as
<br />shall be agreed upon by the Council and the Armory Commission of Virgi-
<br />nia pursuant to the provisions of Chapter 3~3 of the Ac~s of the General
<br />Assembly of Virginia, 1932, and amendments thereto;
<br /> (5) Title to the said armory, including the real estate upon
<br />which it is constructed, s~hall, upon completion or when the work thereon
<br />is otherwise terminate~, be vested in the Commonsealth of~ Virginia and
<br />the City of Portsmouth~ in proportion to the amount of money contributed
<br />by the Armory Commission of Virginia for the construction of the said ar-
<br />mory, including the purchase of the said real estate, and the amount of
<br />money otherwise provided and actually used for the construction of the
<br />said armory, including the purchase of ~he said real estate, and the
<br />said Council shall cause a sufficient deed to be executed to convey tc
<br />the Commonwealth i~s said undivided interest in and to the said armory
<br />and real estate.
<br /> (6) The cost of all repairs, maintenance, insursnce, operation
<br /> s_ud care on, in and about the said armory shall be borne by the City of
<br /> Portsmouth;
<br /> (~) The City of Portsmouth shall keep the said Armory inS~red
<br />at its expense, and shall indemnify and save~harml~ss the Commonweal~
<br />of Virginia and the Armory ~mission of Virginia from any and all loss
<br />resulting frOm or arising o~t of any and ali accidents and injuries to
<br />persons and property in any way connected with or resulting from the
<br />construction, use, operation or occupancy of the said armory;°
<br /> (~) The money to be contributed by the A~mory ~ommisslon of
<br /> Virginia shall bepaid at such time or times, and in such manner as
<br /> shall be agreed upon by the Council of the City of Pcrtsmouth~ and ~he
<br /> Armory Commission of Virginia;
<br /> -(9) All deeds, contracts and other instruments pertaining to
<br /> the conditions herein set forth shall be subject to approval by the
<br /> Attorney General of Virginia;
<br /> (lO) Before the terms of this resolution shall become effective,
<br /> the terms and conditions herein set forth shall be accepted for and
<br /> behalf~ of the City of Portsmouth by the Council of the said City.~
<br /> (ll) When this resolution shall have been adopted by your appro-
<br /> priate municipal authorities and this department has been advised there-
<br /> of, then, upon duly certified authentication~ of accounts by the Mayor of
<br /> your municipality; (~he representative of the Works Progress Administra-
<br /> tion, in the event of Federal contribution), Mr. Paul Ho Bock, the Engi-
<br /> neer of the Armory Commission, and the Adjutant Geheral, they will be
<br /> placed in line for payment by the Treasurer of Virginia.
