<br /> Motion of Mr. Mutchins to concu~ in the Manager's
<br /> 4,000 feet of hose and to place an appropriation of $4,~00.~6 on recommendation to purchase
<br /> its first reading, was adopted.
<br /> The following communications from the 0ity Attorney were read:
<br />
<br /> 1st - MAs directed by you at your meeting held on July l~th, 1936, I presented
<br /> to the Alcoholic Beverage Control Board, through its Chairman, a request to put into effect a
<br /> regulation to prohibit the sale of wine and beer within the corporate limits of the Oity of
<br /> Portsmouth from 12 o~clock P.M. on Saturdays until 6 o~elock A.M. on Mondays. I submitted
<br /> with the request a copy of the resolution of the ~ity CoUncil.
<br /> I received in reply the attached letter from Mr. John p. McLaughlin, Sec-
<br /> retary of the A.B.C. Board.
<br /> I~ appears from this letter that the A.B.O. Board has considered the mat-
<br /> rev, and refuses to make such a regulation. The letter sta~es that "the Board is of the opin -
<br /> ion that the question of Sunday sales should be determined by the Various localities under the
<br /> State Sunday law..
<br /> As I view i~, the effect of this decision is t_hat if the local auf~hori -
<br /> ties permit to remain open on Sundays, those places licensed ~o sell wine and beer (namely ho-
<br /> ts!s, restaurants, clubs, boats, dining cars, buffet cars and club cars), then those places
<br /> can sell wine and beer. And for the local authorities to stop the sale of wine and beer in
<br /> such places on Sunday, they m. ust close such places under the Sunday labor law.
<br /> I understand that thi~ is the general policy adopted by the Board."

<br /> Motion of Mr. Fox to 'lay on table, was adopted.

<br /> Pud -."At your meeting held on July 2~th, 1936, you referred to the 0ity Mana-
<br />ger and myself a letter from the Blue Ribbon Tavern requesting a refund of $~-79 on account of
<br />penalty paid on its license Sax for the year 1936.
<br /> Upon investigation, I find that the Blue .Ribbon Tavern applied for a Ii -
<br />cense on May ?th, and after the license form was filled out, Mr. Carlton refused to pay the
<br />same because the 01ty Collector require~ him to secure an ~.off and on premises beer and wine
<br />license" costing $125.00. His S~ate license called for an "off and on premises license,, and
<br />the 0ity Collector would not issue an "on premise~ license. Mr. Oarlton then refused to ob -
<br />~ain any licenses. License sheet number 70 was voided by the
<br /> On July 13th, the Blue Ribbon Tavern obtained the following licenses:

<br /> Mr. Carlton stated to me that he did not obtain the restaurant license
<br />before June 15th (the penalty date), due to the fact that the A.B.C. Board may have refused
<br />his State license on July
<br /> In view of the fact that the Blue Ribbon Tavern could have secured the
<br />tobacco, restaurant, weighing machine, and soft drink license without question before June 15th,
<br />and a beer and wine license to correspond to his State license, it is the opinion of the ~ity
<br />Manager and myself that the refund should not be made,"

<br /> On motion, the recommendation of the City Attorney was concurred in.

<br /> The following report from the City Collector was read:
<br />
<br /> 9Mr. Smith R. Britt ingham has purchased lot #792 on west side of Avenue H in
<br />Oak Grove Cemetery, size 20' x 20', and requests that you authorize a deed be drawn for the
<br />same."

<br /> Motion that the City Attorney be instructed to prepare deed for said lot and
<br />that proper officers be authorized to execute same, was adopted.
<br />
<br /> The following ordinance, placed on its firsZ reading at last meeting, and laid
<br />on table until this meeting, was taken up and read:
