<br /> The total cost of the project will be $~O,~6~.~O, of which the Admini-
<br /> stration will supply $60,8Y1o~0, against $9,59~.O0 from the City.
<br /> Inasmuch as State Highway funds of $~,600.O0, coming to the City dur -
<br /> ·ng the fiscal year, ending June. 30th, 193~, hav~ been-approved ~ the Highway COmmission
<br /> work. included in this project, the ultimate actugl cost to the Gzty will be $$,99Y.OO, in
<br /> stead of $9,597.00.
<br /> This project provides for 30,000 lineal feet of concrete curb and gut-

<br /> "Replying to your request that I render my opinion as to the status of the of
<br /> lice of City Manager, in view of. the amendment made to the City Charter by the C~hapter 9~ of
<br /> the Acts of the General Assembly of Virginia, 1936, I beg to report as follows:
<br /> The charter of the City of Portsmouth, as provided for by an Act of the Gen-
<br /> eral Assembly of Virginia, appnoved March lC, 1908, (Acts 1908 page 192), provided:
<br /> ~Section 3. The administration 8~d government of the said City shall be
<br />vested in one pr%ncipal officer, styled the mayor;, a council consisting of two branches, one
<br />of which s~hall be called the "Common Council" and the other called the "Board of Aldermen"
<br />and in such other boards and officers as are hereinafter provided for.
<br /> After the State Constitution was amended in 1912 and an act of the General As-
<br />sembly was~ passed in 191~, steps were taken in the City of portsmouth to change the form of
<br />government of the City. The requirements of Chapter ll9 of the State Code (1919) were com -
<br />plied with, an election was held, and the City Manager-Plain of government was adopted. The
<br />citizens adopted the plan as set forth in sections 29~2, 2943, 29~/~ and 29~5 of the State Code
<br />(1919), with a council of seven members to be elected at large. One of the members was to be
<br />elected President of the Council, who. bsc~me ex-officio Mayor, without the power of veto.
<br /> Under this plan of government,~ "all the legislative powers of theCity, how -
<br />ever conferred or possessed by it are hereby vested in a comucil of from five to eleven mem-
<br />bers in cities above ten thousand inhabitants." (Section 29~2, Code 1919)
<br /> Also, "The administrative and executive powers of the City, including the
<br />power of appointment of officers and employees, are hereby vested ir. an official to be known
<br />as the City Manager". (Section 2943, Code of 1919).
<br /> "(1) The City Man~ger shall see that within the City the laws, ordinances~ resolutions
<br />and by-laws of the Council are fait?~ully executed; (2) attend all meetings of the Council
<br />and recommend for adoption such measures as he shall' deem expedient; (3) make reports to the
<br />Council from time to time upon the affairs of the City; keep the Council fully advised of the
<br />City's financial conditions and its future financial needs; (~) prepare and submit to the
<br />Council a tentative budget for the next fiscal year; (5) he shall perform such other duties
<br />as may be prescribed by the Council, not in conflict with the foregoing, and shell be bonded
<br />~e the Council may deem necessary." Section
<br /> It is further provided "that such officers and employees that the Council of
<br />the City shall determine are necessary for the proper administration of the City, whether
<br />such officials or employees be state or municipal, with .exception of those in the financial,
<br />legal and judicial departments, and the clerical and other attends_uts of the City Co-mucil,
