891 <br /> February 27, 1996 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the Deputy City Manager <br />for Finance be, and hereby is, designated the Authorized <br />Agent of the City of Portsmouth, Virginia, for the purpose of <br />providing such assurances, agreements, and data on behalf of <br />the City as may be required to obtain federal financial <br />assistance under the Disaster Relief Act ("the Act") {Public <br />Law 288, 93rd Congress), or from any other federal source; <br />that the City Manager be, and hereby is, authorized to <br />execute and deliver a form to this effect; and that the <br />Authorized Agent be, and hereby is, authorized to apply for <br />financial assistance under the Act for the snow storm of <br />January 13, 1996." <br /> <br />Ayes: Clemons, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-80 Letter from the City Manager recommending adoption of <br />a resolution authorizing the City Manager to submit an <br />application and execute documents to apply for a seventh year <br />of State funding from the Chesapeake Bay Local Assistance <br />Department to offset the cost of conrplying with the <br />Chesapeake Bay Preservation Act. <br /> <br /> "The Chesapeake Bay Local Assistance Department, an <br />agency of the State of Virginia, requests proposals for <br />programs to implement the Chesapeake Bay Preservation Act and <br />Regulations. Approximately $650,000 will be awarded directly <br />to local governments and planning districts on a competitive <br />basis. <br /> <br /> If a grant is awarded to Portsmouth, the Plannlng <br />Director proposes to offset some of the costs associated with <br />the Bay Act. The grant would be matched with "in kind" <br />services and a salary supplement for our environmental <br />planner who manages the City's Wetlands Ordinance, Floodplain <br />Verification Program and the Chesapeake Bay Preservation <br />Overlay Ordinance. The City has been successful in applying <br />for and receiving this grant for the past six years. <br /> <br /> I, therefore, recommend approval of a resolution <br />authorizing submission of an application and permission to <br />sign all necessary documents related to the grant." <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Clemons, <br />adopt the following resolution, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN <br />APPLICATION TO THE CHESAPEAKE BAY LOCAL ASSISTANCE DEPARTMENT <br />FOR FUNDING FOR AN ENVIRONMENTAL PLANNER POSITION TO OFFSET <br />THE COSTS OF COMPLYING WITH THE CHESAPEAKE BAY PRESERVATION <br />ACT. <br /> <br /> WHEREAS, in order to comply with the provisions of the <br />Chesapeake Bay Preservation Act ("the Act"), the City of <br />Portsmouth, Virginia ("the City"), has been required to <br />implement major changes in its development review procedure, <br />its ordinances and its Comprehensive Plan; and <br /> <br /> WHEREAS, the Commonwealth of Virginia, through the <br />Chesapeake Bay Local Assistance Department ("CBLAD"), has <br />made available to localities, on a competitive basis, certain <br />funds to help defray the Act's implementation costs; and <br /> <br /> <br />
