<br />from North Street, between Middle and 0curt'Streets, formerly refer-
<br />red to as Herbert's Lane and now commonly called Eastwood's Lmue; the
<br />ls~e is not shown on the available copies of the original map of PorZs-
<br />mouth. The survey made by Bascom Sykes, City Engineer of the City,
<br />adopted by the City Council August 13, 1901, shows the lane as being
<br />open, but does not show its location in reference to Middle and Court
<br />Sis. I have made a survey of the property, and I find that the lame
<br />as it has been opened and used by the public for a sufficient length
<br />of time to make it a public thoroughfare, is ten feet wiie, and that
<br />its east side begins at a point on the north side of-North Street,
<br />distant one hundred and fifteen and five-tenths (115.5) feet west from
<br />the northwest intersection of North mud Middle Streets. It axtends along
<br />a walkway and the rear pbrtion of the house number 308 North Street, be~-
<br />longing to B.P. Pettus, northward,~clearing the west wall of said house..

<br /> On the night of ~hat day, the Ci~y Council extended the ~ime of the
<br />relief of the interest and penalties to December 15, 1936, and on the 14th day of December,
<br />Mrs. Corbltt paid the remaining taxesdue on the property for 193~, 1935 and 1936.. Had she
<br />withheld the ~ayment of the 1933 taxes on December 8th, she would not ha~e'been required to
<br />~pay the interest, penalty and advertisement.- I ~m informed by Mrs. Corbitt that she did
<br />not know the period of grace would be extended when she oaid the taxes on December 8th, and
<br />she would have wai~ing until the lhth, had she khown it was going ~o be extended. She
<br />made a special effort to pay the remaining taxes. Under the circumstances, it apoears to
<br /> me that Mrs. Corbitt is entitled to have the sum of $~2o40 refunded to her.~ -
