<br />The following communications from the City ~anager were read:

<br /> let ~Several weeks ago, Attorney James G. ~artin and Judge Tom Gilmsn
<br />brought suit for $10, OOOo against the City,~ in behalf of Joseph Holland, a boy who lost some
<br />of his fingers playing with a road machine, which was left overnight a~ the corner of Fifth
<br />Ave. ~nd Queen St.
<br /> ~r Barclay and I felt that the Jury would probably ~ve to render
<br /> some verdict ~ favor of the plaintiff. However, on the day of the trial~ Attorneys Martin
<br />~and Gilman agreed with~. Barclay, to settle this $10,000. sui~ for $300,, which we did."

<br /> 2~d ~ ~The City Attorney, ~r. Barclay, has been honored by the Woodmen of the
<br />World, as a State Delegate to their National Convention at Los Angeles. He will be away
<br />goou~ three weeks, beginning June 12th.
<br /> I recommend that the Council grant him this leave of absence, with pay.
<br />~C~otain H%oper~ who was for many years City Attorney, has agreed ~o serve during Nr. Barclay's
<br />absence.~

<br />~otion of ~ro Howard to concur in the ~8~uager~s recommendation, was adopt'ed.
<br />
<br /> 3rd - "The exper~ accountants, J.A.D. Panfish and Como~uy, have finished the
<br />City audit for the year 1936. They seem to have made a complete report.
<br /> A copy of the audit can be found in the City Clerk's office, and is
<br />available to any councilman, who may desire to examine it.~

<br /> 4th - ~The State Deoartment of P~oiic W~ifare, for Zhe fiscal yea~, begin
<br />nine July 1st, 193o, appropriated $17,~5o.15 to Social Service assistance in Portsmouth. The
<br />City of Portsmouth added to t~at amount
<br /> I have a letter from Mr. Fo W. Gwaltney, Ass~stent Director, Public
<br />Assistance Division, which sta~es that the State will contribute the same amount for ~he year
<br />beginning July 1st, 1937, provided ourClty will appropriate its matching fund of $10,473o69.
<br />One half of ~his amount, which carries the relief work ~o to J~uuary 1st, 193~, has been
<br />vided for in our 193Y budget; the other half of course will be provided for in the 1938 bud~
<br />ge~. The State requires the Council to pass a resolution authorizing the CityNanager ~o sign
<br />this agreement with the State, copy of which must be forwarded ~o the State Department in
<br />Richmond. Resolution which they ask the Council to adopt, is attached.~

<br /> Be i~ Resolved by ~he Council of the City of Portsmouth, that
<br />need of state assistance existing in the City of Portsmouth, to provide
<br />for destitute persons in need of public relief, application is herewith
<br />made to the Commissioner of Public Welfare, pursuant to provision of
<br />Ch~oter 2~3, AcZs of Assembly, 1936, for participation in the State Re-
<br />lief appropriation subject to the provision of the said Act and Rules
<br />and Regulations, which have been adopted or may hereafter be adopted by
<br />the Governor, pursuant to the provisions of the said Act~ which ~t is
<br />herewith 8g?eed will be complied with in the a&ministration of said
<br />funds. It appearing under the said Act that said City of Portsmouth is
<br />entitled to the sum~oft $I7,456.15, for the year beginning July I,. !93~
<br />provided the said C, y of Portsmouth appropriates the sum of $10,~Y3.69
<br />to match said state allowance, be it, therefore, Pesolved that applica=
<br />tion is hereby made for State Funds in the amount of $1Y~456o15 and that
<br />the sum of $10,~73.69 is hereby appropriated to match the state allow -
<br />mute, which is 60~ of the total state a~ount applied for; end the same
<br />is to be segregated and expended in the manner provided by said Act and
<br />the Rules and Regulations adopted pursuant thereto.
