March 26, 1996 <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Griffin, <br />adopt the following ordinance, and was adopted by the <br />following vote: <br /> <br />&25 <br /> <br />to <br /> <br /> "AN ORDINANCE TO APPROPRIATE $175,000 FROM THE CAPITAL <br />IMPROVEMENTS FUI~-D FOR CONSTRUCTION OF A CONCRETE PIPE OPTION <br />FOR CAVALIER BOULEVARD PIPING." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, P~tts, Robinett, Webb <br />Nays: None <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Martin, <br />increase the contract awarded to Art-Ray Corporation by <br />$175,000, and was adopted by the following vote: <br /> <br />to <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-118 - Letter from the City Manager recommending adoption <br />of an ordinance which will allow the Department of <br />Environmental Services to serve summonses. <br /> <br /> "Historically, housing and environmental code related <br />summonses were first served by the Police Department. Around <br />1990, Sheriff Waters volunteered to serve summonses for the <br />Department of Environmental Services as well as all summonses <br />issued by the City of Portsmouth. Last fall, the Sheriff <br />indicated the volume was more than he could handle, but <br />agreed to continue service for the Department of <br />Environmental Services until April 1, 1996. <br /> <br /> Since the administrative hearing process was instituted <br />by the Department of Environmental Services in January, the <br />number of summonses from that Department has dropped <br />significantly. It is anticipated that the nun~ber will <br />continue to drop, and therefore,, the Director of <br />Environmental Services believes that her Department will be <br />able to handle the serving of these summonses. Also, as <br />information, the cities of Norfolk and Virginia Beach provide <br />for summonses to be served by code inspectors and have found <br />this approach to work well. <br /> <br /> The attached ordinance provides for certain staff of <br />Department of Environmental Services the right to serve <br />summonses. I recommend adoption of this ordinance." <br /> <br />the <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Pitts, <br />adopt the following ordinance, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 17 OF THE CODE OF THE <br />cITY OF PORTSMOUTH, VIRGINIA (1988) BY ADDING THERETO <br />SECTIONS 17-29 ~ 17-30, PERTAINING TO HOUSING AND COMMUNITY <br />DEVELOPMENT." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />96-119 - Letter from the City Manager recommending adoption <br />of a resolution requesting the Virginia Department of <br />Transportation's approval of additions, deletions, and <br />changes of certain City streets eligible for State <br />maintenance payments under the State Functional <br />Classification System. <br /> <br /> "Each year the City of Portsmouth submits to the <br />Virginia Department of Transportation a list of additions, <br />deletions and changes to the streets eligible for maintenance <br />payments under the State Functional Classification System as <br />set forth in Section 33.1-41.1 of the State Code. These <br />roadway sections are located primarily in new subdivisions <br />where the streets were recently completed by the developers. <br /> <br /> <br />
