March 26, 1996 <br /> <br />The project provides parking, building access and <br /> <br /> (h) <br />pathways for persons with disabilities in accordance with <br />requirements of the Americans with Disabilities Act. <br /> <br />4.23 <br /> <br />the <br /> <br /> 2. That a group housing use permit for the construction <br />of four townhouse residential units at 5645 Parish Lane is <br />hereby granted to the applicant, Herbert G. Drier, subject <br />to the following terms and conditions: <br /> <br /> (a) The group housing project shall be limited to one <br />building containing four townhouse residential units. <br /> <br /> (b) The project shall be constructed with a full brick <br />front facade on each of the two center units and with an <br />18-inch brick skirting around the entire building. A revised <br />plan showing the placement of brick shall be approved by the <br />Director of Planning prior to the issuance of any <br />building permits. <br /> <br /> (c) A landscaping plan showing a buffer strip between <br />the proposed building and Parish Lane shall be submitted to <br />the Planning Department for review and approval prior to the <br />issuance of any building permits. <br /> <br /> (d) Shutters shall be installed on all windows, except <br />any bay window, facing Parish Lane. <br /> <br /> (e) Any revisions to the site plan, to the landscaping <br />plan, or to any elevation made through the group housing <br />application process, including any changes in response to any <br />requirements by the City Council , must be submitted to the <br />Planning Department for review and approval prior to the <br />issuance of any building permits. <br /> <br /> (f) The applicant shall be responsible for the cost of <br />upgrading utilities required for the construction and <br />operation of this project. <br /> <br /> (g) The applicant and any successor in interest shall <br />comply with all applicable statutes, ordinances and <br />regulations of federal, state and local governments and shall <br />obtain and maintain in effect all required permits. <br /> <br /> (h) EXPIRATION OF PERMIT: Pursuant to Section 40-115 of <br />the Code of the City of Portsmouth, Virginia (1988), the <br />group housing use permit shall expire if the applicant fails <br />to apply for all building permits for the entire project <br />within one year of the adoption of this resolution or if he <br />fails to secure an <br />extension of the expiration deadline as provided in said Code <br />section. <br /> <br /> (i) REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as a basis for revocation of the permit <br />by the City Council." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, <br />Nays: None <br />Abstained: Robinett (Due to a business <br />applicant) <br /> <br />Pitts, Webb <br />relationship with the <br /> <br />- CITY MANAGER'S REPORT - <br /> <br />96-116 Letter from the City Manager recommending adoption <br />of an ordinance to appropriate $400,000 from the Capital <br />Improvements Fund for construction of a work release/ laundry <br />facility for the City jail, and a motion authorizing the City <br />Manager to enter into a contract with the lowest responsible <br />bidder. <br /> <br /> <br />
