Under the State Law, it is exemp- <br />tion f~om taxation. <br /> V~nile taxes are assessable as of the first day of January, it has been the <br />custom of the City. Council to relieve chu~cnes~ ~ and-lodges of taxes fBom_ the date of their pur- <br />chases. In conformity with this custom the lodge is entitled ~o be relieved of $147o~7 for <br />eight months and five days of 1934, as and when the bal&nce of the tax is paid." <br /> <br /> Motion of Mr. Fox to concur in the Attorney's recommendation, was adopted. <br /> <br />- NE~ BUSINESS <br /> <br /> Bill of J.Shirley Hope, Statue G~me V~arden~ for destroying eighty-three tagless <br />dogs, at $2.50 each, amounting to $20Yo50, w~s presented, and on motion of Ere Howard, the <br />Treasurer was authorized to pay same from funds in her hands from collection of Dog Taxes. <br /> <br /> The following letter was read, and on motion of Er. Fox, was referred to the <br />City Attorney: <br /> <br /> "Under date of August 2?th, !936, Lawson and Newton of Norfolk, Va., who deal <br /> in monuments and mausoleums, paid to the Treasurer of the City of Portsmout~ $~6.00 for a <br /> city license, which, at that time, was demanded and required by the City of Portsmouth before <br />'the City would permit the Norfolk fi~m to erect a monument in the cemetery. <br /> l~ior to the payment of this money, a~protest was made to the City Manager <br /> and the matter was discussed with the City Attorney. The City refused to per, nit the Norfolk <br /> firm to complete its contracts by the erection of its monuments in Portsmouth, unless this <br /> license w~s paid, whereupon, it w_as paid, under protest. <br /> It has come to my attention t!iat in a similar ease of Midland vs. City of <br /> Portsmouth, that the Hustings Court directed that the amount collected for the license fee be <br /> returned. It is believed that the City of Portsmouth would surely desire to handle these <br /> cases on a similar basis, and therefore, it is requested that the City Council take the neces~ <br /> sary action to cause a refund of the amount heretofore improperly paid amounting to $76.00, <br /> to be returned to Lawson and Newt$n of Norfolk, Va. <br /> Evidence of the pa~nent of the.sai~d amount will be submitted if desired, and <br />s!so any other ~ information, but your City Attorney is thorougkly conversant with the facts, <br />for this matter has been tsken up with him a number of times, and this request has been Wi~h~ <br />held pending the outcome of the Midland case. <br /> <br />Your~ very truly, <br /> <br />for August, 1938, <br /> <br />Report <br /> was received and'ordered filed. <br /> <br /> William Ho Sands." <br /> <br />of F.
