<br /> Minutes of the regular meeting held January 24th were read s~ud approved.
<br /> The following communications from the City Manager were read:

<br /> let ~On February 7th, i received a teiegran from Congressman Darden, stat-
<br /> ing that the stadium project had been approved in ~fashington.
<br /> The Stadium~ Con~nittee, consisting of Mayor John P. Leigh, T.A. Wil-
<br />lett. Frs~k D. Lawrence, Leslie T.Fox,-,~.H. Rappoport and City Engineer Haug~ met in the
<br />ager~s office at ten o'clock this morning, with architect George Van Leeuwen~ F. W. Dunn, lo-
<br />cs~ ~.P.A. representative, and Mr. ~Dm._ton, of the S~ate Director's office, 'LP.A. Richmond,
<br />and we agreed to employ Mr. Van Leeuwen.
<br /> Before the work is begun~ the ~[ayor, Manager smd Stadium Committee,
<br />will meet with ~he architect, on the ground, to decide the exact location of-the various parts
<br />of the stadium..We will be ~lad for any members of the Council, who can do so, to meet with
<br />us, on that occasion. ~
<br />
<br /> Motion of_Mr. Hutchins that the report of the committee be concurred in and
<br /> that the Council commend the committee on its splendid work, was adopted.

<br /> 2nd - "On February 8th,-Col. Jo_hn H. Carruth~ District Engineer of tb~ Fed-
<br />oral Government, wrote me as follows:
<br /> ~Reference is made to.the recent request of the City
<br /> of Portsmouth amd~its citizens for the improvement of Scott's
<br /> Creek, Virginia, considered-at-a public-hearing conducted by
<br /> me in Portsmouth, Va., on October 4th, 1938.
<br /> The reviewing authorities have returned my prelim in-
<br /> ary report on the subject, requesting among other items that
<br /> additional information be furnished as to the extent of co-
<br /> operation which may be expected from local interests. I be ~
<br /> lieve that it wo~zld be advisable for you, and other parties
<br /> vitally ~nterested Ln the proposed improvement, to discuss the
<br /> entire situation with me. Accordingly, I would be pleased to
<br /> have you s~ud your party call at-this office at your'earliest
<br /> convenience.
<br /> You may advise me by telephone (Norfolk 2~214) when
<br /> it will be practicable for you tO call.~
<br /> I immediately contacted hi~ by ~phone, and a delegation, consisting of
<br />the Mayor, Councilmen Hutchins, the City Engineer, Secretary of the Chamber of Commerce, and
<br />the City Manager, met with. Col. Carruth in his office in Norfolk, at 10:30 on Friday, the 10th
<br />at which ti~e the proposition was discussed at length~
<br /> Col. Carruth is willing to recommend that a channel eight feet deep
<br />s[ud one hundred feet wide be provided Scott's Creek, stl the way up to the bridge at Leckie
<br />St., with a turn-around basin at the Leckie St. bridge; provided the City can afford, and
<br />will pay one half of the cost, which the Colonel said will not exceed $12,000.00.

<br /> ~ I recommend that as soon as convenient, all the m~mbers of the Council,
<br />togetherwit~h the Manager, meet~ one day next week, at the Leckie St. Brimge, and view the
<br />premises. I think, after that ms done, we w~ll be ~ole to decide ~mether the City should
<br />spend that much money on this partict~ar pro~ect, at this time.~
<br />
<br /> Motion that the report be filed s_ud tha~t-the Council meet at the Leckie St.
<br />bridge, on Friday~ February 17th, at lO:C0 A.M., to view the situation, was adopted.
<br />
<br />The following communication from the City Attorney was read:
<br />
<br /> "In connection with the letter of Mr. E.C. Allen, Cashier of the American
<br />Nation, al Bank, requesting a refund of $189.30 for 5/39 of the ts~xes oaid upon waterfront
<br />perry, Swimming Point, assessed to the American Nation~ Bsnk of Por~tsmouth, the laws of the
<br />State do not provide for assessments against part interest except in those cases where timber
<br />or mineral rights a_~e o~ed separately from the land. If two or more people own one parcel
<br />of land, it is assessed as a whole and not against the oysters accordi~ug to their separate
<br />interests. Should one of the owners pay the taxes, he csm hold the amount paid as a charge
<br />against the other owners~ interest. Under these circumsts_'~ces, i do not see how the City
<br />refund the amo-~r.t requested."

<br />Motion of Mr. Hutehins to approve said report, was adopted.
