account of
suit.

Attorney and I have reached an agreement
case for $50.O0, subject to the approval

Minu~es of re~dl~ meeting held November 14th, were read and ~oproved.

The following communications from the City Manager were read:

1st '~Several weeks ago, Mrs. Thelma Evans claimed to have been injured on
s~epping in a hole in front of 201 Jackson Ave., and she employed a lawyer to bring

I ~xamined the place and found a short bresl[ in ~e curbing. The City
wit2~ Mrs. Evans~ attorney, Mr. Levin~ to settle this
of the Council.

Motion of Er. ~wara to approve th9 Manager's recommendation, was adopted.

2nd - "At the last mesti~g of the Council, there was referred to me applica -
tion for oension by J.W. Gr~ut~ who has been emoloyed by the City for sixteen years and seven
months (a~ mechanic).
~h~ City received ¥~. ~p~ut~s payments to the Pension Fund, I am of
the opinion that he is entitled to a pension, but he can no~ be retired as a fireman because
he has never been a fireman and is not covered by the ordinance creating the Pension Fund.
~ne Council has the authority to retire Dim at the s~e rate of pay,
%~ich is $62.50 per month~"

tirement pay to

.for basket ball.

Motion of Mr. Hutchins to retire Mr. Gra~ut, for seventeen yeare~ service, re-
begin August 16th, was adopted.

- ~ ~ %~nite and one colored, to use the Armory
3rd "We have two apolicat_ons, one

~.~nen the Armory was first built, the two Batteries required the use of
it only tu~-o days a week. That left four days that the City could rent it, and get part of the
income necessary to defray the expense of maintaining it~
Recently the number of men in the Batteries ha~ been almost doubled.
General ~aller, for the present, requires the use of the Armory four days~ instead of two.
This leaves only two days a ~eek that we can rent it."

On motion ordered filed.

4th - "The amount ps~d in~o the Retirement Fund by C~ot. James Ts~lbot is
$308.5Y~ and by Capt~ Jahn Sh~unon, $269.81~ but neither of these amounts cs~ be refunded un-
less the ordin8~ce creating the Pension Fu~d is chs~ged.
Should we pay these death claims, it would be only fai~ to go back for
a number of years and do the same thing for every firem~u and policeman who has died since the
Pension Fund has been in effect, and also, it should apply to all who may die in the future,
which means ~ll of them.
I ~ of the opinion t?~t, in this case~ we would set a precedent that
t~ City can not live up to."

Motion of Mr. Fox that should any member of the ~ ~' - ~
.o~!oe or Fire Deoartment
serve twenty or more years with sai~ deoartment and die without receiving a pension, the ~moun~
paid ~ ~
_n~o the Pension Fund by said pensioner shall be refunded~
