in the yard of the property. Er. Brown,s contention is that the sewerage backed up and soft-
ened the ground around the foundations of the house causing it to settle. From the condition
of the lateral under the pavement it is evident that this condition existed for quite some
time.
This building wa-s repaired~ p~i~ted and papered about five months a go, and
from the looks of the cracks in the fresh paper and walls, the settlement occurred since the
repairs were made and during the sewer trouble.
Mr. Brown has ~ad.~ th~ house Jacked~up'Jand repaired at the point of settlement
and has bills for $52.00 labor and material, plus a bill for $2.50 for plumber's time or a
total of
We believe that the settlement~ of the house was caused by the backing up of
the sewer and that Er. Brown sti~uld '~o~.~-imb~ed for the amount above stated.
