<br /> 1st - The City Mansger presented the following letter, ~ioh was ordered
<br />filed:
<br /> "This is to advise that I have completed my investigation, relative to
<br />the establishment operated by $. Stein, trading as Bri&nton Service Store, and located at 542
<br />Highlan~ve.
<br /> I was assisted in this investigation by three undercover agenZs, w5m
<br />same here for that pu_~pose, and observed the est~olish~ent,myself on several occasions.
<br /> None of the soecial agents, or myself, were able to observe any viola-
<br />tiors of the A.B.C. Act, and for an e%tablis~ment that caters strictly to all classes of co! -
<br />ored trade, we s~e of the opinion that the est~olis?~ent is operated in sn unusually good man-
<br />ner.

<br />lish a monument marker business at 923 Sixth St., recommends that the same be not allowed.

<br /> M~tion of Mr. Warren to concur in the Committee's recommendation, was adopted.

<br /> ~th The M~.ger presented the following resolution, with recommendation
<br />that the Council approve same;
<br />
<br /> "WHEREAS, the City of Portsmouth is the owner of a parcel of
<br />land situated on the North side of High Street, beginning at a point
<br />50 feet, 2 inches~ more or less, east of the northeast intersection
<br />of Court and High Streets, fronting on High Street~ 130 feet, with a
<br />deoth of ll3 feet, which parcel of land was leased by the Trustees
<br />of the Town of Portsmouth to William King~ William Barnard, David A.
<br />Reynolds and Eliza Keenan, by ~9 year leases, renewable forever; and
<br />
<br /> ~:EqEREAS, the Portsmouth Improvement Company is now the holder
<br />of said leases~ and
<br />
<br /> ~EREAS, the Portsmouth Improvement Como~uy is about to b or -
<br />.-ow $1ZO,O00oOO from the Massachusetts Mutual L~fe Insur~uce Company
<br />of Springfield, Massachusetts, to ~e secured by a deed of trust on
<br />its interest in the property above mentioned, together ¢~t h other
<br />real estate o~ed by it; e~d

<br /> ~E~REAS, said Massachusetts Mutual Life Insurance Company
<br />desires the consent of the City of Portsmouth to the execution of a
<br />deed of trust on said property and the Portsmouth Improvement Com -
<br />pany, ~s applied to the City for such consent.
<br />
<br /> NOW, THEREFORE, BE IT RE~OLVED by the Council of the City
<br />of Portsmouth, that the consent of the City is given to the Ports-
<br />mouth Improvement Co~any to encumber the interest of the Ports -
<br />mouth Improvement Company in the said property s~ove mentioned, to
<br />secure a sum not exceeding $1~O,OOOoO0 but it is expressly under -
<br />stood that the City of Portsmouth, by giving its consent to the
<br />Portsmouth Improvement Company, to encu~mber its interest in said
<br />property, does not release or relinquish any of its rights as les-
<br />sor in said property~ nor shall the said consent be construed as
<br />giving to the Portsmouth Improvement 0ompany, or its assignee, or
<br />crs~utee, the ~ee simple estate in Said property.~
