<br /> vices, that. it will maim~in in good ~epalrar~l working orde~ ~uy and all municipal utilities
<br /> and f~¢ilities, provided~by it for the use and benefi~ of the Project and the tenants thereof;
<br /> and that it will maintain-in good repair s~reeSs, roads and alleys which are within, adjacent
<br /> or leading to the boDuudariea of ~he Project. The term "useful life of su~hProJect" as used in
<br /> the foregoing, shs~ll mean the period of physical usefulness1 of the Project for the purpo se of
<br /> providing dwelling accommodations, but in no event less tl~an the number of yea~s during whieh
<br /> any of the obligations issued to aid in financing ~e development of the Project shall remain
<br /> ou~standdng.
<br /> 3. For the mumiclpal services, l~provements and facilities furnished by the
<br /> Oity, (.,and by t~he School Board of the City in educating ~hild~en), for Project No! VA-l-1 an&
<br /> for the tenants tt~ereof pursuant to the provisions of Paragraph 2 of this agreement, the Au -
<br /> thority~so long aa said Project No. VA-l-1 is used for the purpose of~providing housing for
<br /> persons engaged in national defense activities) s~hall pay to the City annually, as a part of_
<br /> the cost of operation, in lieu of taxes and in lieu of other fees or charges ~with the excep
<br /> tion of the charses for Fater and ~uy~ah~rge ~or_ sewage~treatment or disposal tJ~at may here-
<br /> after be Impose~) a sum (hereinafter called the "Lo_~l Service 0barge for Project Nc.VA-l-l")
<br /> equal to the cost t~ the City of such municipal services,~improvements and facilities; pro -
<br /> vided, howewer, that the local service charge for Project No. Va-l-1 shall in no event be
<br /> more than $20,000. per annum, and provided further th~~ when Project No. VA-l-! is nc longer
<br /> needed and used for the purpose of providing housing for persons engaged in'national defense
<br /> activities and As converted to and used as a low-rent housing project providing decent, safe
<br /> and s~uitary dwellings within the financial reach of families of low income for which annual
<br /> contributions are made available by the United States Housing Authority for the pu-~pose of
<br /> achieving and maintaining its Iow-rent character, and the rents for Project No. VA 1-1 are
<br /> reduced, then and in that event the Local Service Oharge for Project No. VA 1-1 ~uall be re-
<br /> duced in direct proportion to the ratio that the aggregate annual income derived by the Autho,
<br /> rity from the shelter rent (being the total of all rents chargeable e~cluding the charges for
<br /> utilities such as gas, electricity, water and light) from Project No. VA 1-! after su~n con-
<br /> version and reduction in rents bears to the ~ggregate ~unual incom~ derived by the Authority
<br /> from the shelter rent ~as ~oovedefined) in the year preceding such conversion and reduction
<br /> in rents. (A~ illustration marked "Exhibit A" of the manner in ~nich the provisions of this
<br /> paragraph would operate is attached hereto and made a part hereof).
<br /> 4. ~or the municipal sea, ices, improvements ~ud facilities furnished by the
<br /> 0ity (and by the School Board of the Oity Lu educating children), for Project No. VA 1-2 and
<br /> for the tenants thereof pursuant to the provisions of Paragraph 2 of this Agreement, the Au -
<br /> therlty (so long as said ProJe ct No. VA 1-2 is used for the purpose of providing housing for
<br /> oersons engaged in national defense activities) shall pay to the 0ity annually~ as a ~art of
<br /> ~he costs of operation, in lieu of taxes and i~ lieu of other fees or charges (with thee xcep-
<br /> tion of the charges for water and any charge for sewage treatment or disposal tb~ may hereaf-
<br /> ter be imposed) a sum (hereinafter called the "Local Ser~ce. Oharge for Project No. VA
<br /> equal to the cost of the Oi~2 of such municipal se~¢ices, improvements and facilities. Pro
<br /> vided, however, that the Local Service charge for Project No. VA 1-2 shall in noeven~ be more
<br /> than $10,O00. per annum, and provided further that when Project No. VA 1-2 is no longer
<br /> ~eeded and used for the purpose of providing housing for persons engaged in national defense
<br /> ac~ivities and is converted to and used as a low-~nt housing project providing decent, safe
<br /> and sanitary dwellings within the fin~ucial reach of families of low income for which a~nual
<br /> Con~ributions are made available by the United States Housing Authority for the purpose of
<br /> achieving and maintaining its low-rent character, and the rents for Project Nc,VA 1-2 are
<br /> reduced, then, and in that event, the Local Service Oharge for Project No. VA 1-2 shall be
<br /> reduced, in direct proportion ~'~he ratio that the aggregate annmal income derived by ~he
<br /> Authority from the shelter rent (being the total of all rents chargeable excluding the charges
<br /> for utilities such as gas, electricity, w~ter and light) from Project No. VA 1-2 after such
<br /> conversion ~ud reduction in rents bears to the aggregate annual income derived by the Autho -
<br /> rity from the shelter rent (as above defined)in the yea~ preceding~such conversion and reduc-
<br /> tion in rents. (An illustratlbn, marked "Exhibit B~' of the manner in which the provisions of
<br /> this paragraph would operate is attached hereto and made a part hereof.)
<br /> 5- The Local Service 0barge for Project No. VA 1-2 shall be payable in ad
<br /> vance on the first day of January next succeeding the date when Project No. VA 1-1 is substan-
<br /> tially complete amd ready for occupancy and annually thereafter on the first day of January
<br /> in each year.
<br /> For the year i~ which such projects are completed the respective "Local
<br />Service 0harges~ shall be pro-rated and paid to the 0ity as soon as sufficient funds are re -
<br /> ceivedby the Authority.
<br />
<br /> 6. The Oity agrees to waive such building and in~oection fees as might be
<br />payable by theAuthority if it is or becomes Subject to t~e payment of such fees, and agrees
<br />to make exceptions fx~m building regulations and ordinances as are found by the Authority to
<br />be necessary in the development of the Project.
<br /> ?. The Authority agrees:
<br /> ~a) That it will use its best efforts to develop~ the project as rapidly
<br />as oossible, and to ksep the Oity fully informed as to the status of the project.
<br /> - ~b) That in laying~ out new streets and parkways it will do all work
<br />necessary for the completion of the same ~n a per~.nent and satisfactory manner' and to the
<br />satisfaction of the 0ity Engineer of the 0ity and th~.t~it will extend all necessary water
<br />pipes and se~r lines as a part of the project, and that the 0ity will not be required to makel
<br />any capital expenditures in the construction of the project, or otherwise°
<br /> (c) That it will furnish to the 0ity annually fiha~ucial statements of
<br />its operations, and it will permit its books to be audited by auditors employed by the 01ty
<br />upon request.
