<br />Minutes of regular meeting held October 8th were read and approved.

<br />The following communications from the City Manager were read:

<br /> 3rd - ~"At eleven o'clock today, we opened bids for 1,2OO tons Typ_e H-I
<br />bituminous surfacing mater~al, and the lowest bid was $5.$3 per ~on delivered, which amounts
<br />to $6~516.OO.
<br /> We have in the Street Funds $3,500°00 we can use~ but we need an
<br />additional appropriation of $3,000.00. This will enable us to make a first class street of
<br />South Street, from Crawford to Effingham, %thich will take some of the congested traffic away
<br />from H~gh St. The W,P.A. has agreed to furnish the labor.

<br /> Motion of Mr. Fox to concur in the Manager's recommendation and to place
<br />an appropriation of $3,OO0,OO for said purpose, on its first readdng, was adopted.
<br />
<br /> 4th ~ ~As directed by resolution, passed at your last meeting, I gave ten
<br />days notice by advertisement in the 'Portsmouth Star~ that I would proceed to sell the three
<br />parcels of land in Lake Kilby, at public auction~ on Tuesday, October 22nd, 1940, at twelve
<br />o~c!ock~ noon, in front of the Court House in the City of Portsmouth.
<br />I attended the sale, and the property was purchased on behalf of
<br />the Norfolk & Western Railway Oompany, it being the highest bidder, for the sum of $2,000°00.
<br /> I recommend tP~t the sale be confirm-ed and that the property be
<br />sold upon the condition that:
<br />
<br /> ~The Norfolk and Western Railway G0mpany will agree
<br />that .it will not, at any time, either in the construc2ion of
<br />~its works upon the said land or any use which it shall ms~e of
<br /> the s~ne, narrow, shorten, or otherwise impede the existing
<br /> channel connecting portions of Lake Kilby, or interfere with
<br /> tSe flow of water in said lake, or that it will commit any act
<br /> which can be reasonably avoided, vfnich will contaminate the
<br /> water in the lake or make it objectionable for use as a public
<br /> water supply for human consumption~ or change or interrupt the
<br /> normal operating conditions of tAe filtration plant of the City
<br /> of Portsmouth at the Lake Kilby pumping station.'".
