361 <br /> <br />vote: <br />ordered filed. <br /> <br />"AN ORD~CE ~0 A~_END A~D RE-ORDAIN SECTION 2 OF 'AN ORDIP~ANOE <br />EJ~TITLED~ ~At~ ORDINANCE RELATING TO TRAFFIC AND REGULATING THE <br />USE OF CERTAIN STREETS AND HIGHWAYS IN THE CITY OF PORTSMOUTH; <br />PRESORIBiNG RE~TIONS RELATIVE TO THE PARKING OF VEHICLES UPON <br />SUCH PUBLIC STRzETS AND HIU~HWA~S, PBOVIDI~'G FOR THE INSTALLATION,. <br />OPERATION, MAINTENANCE, SUPERVISION~ REG~JLATION~ AND CONTROL OF <br />THE USE OF PARKY~G METERS; DEFINING AND PROVIDING ~OR THE ESTAB- <br />LtSP~ENT OF PARKING METER ZOI~ES UPON CERTAIN PUBLIC .STREETS AND <br />HIGHWAYS; PROVIDING ~OR THE PA~ENT ~OR PARKING METERS AND THE <br />INST~L~ATION ~D~ ~LAINTENANCE THEREOF; PROVIDING FOR THE ENFORCE. <br />NENT THEREOF; PROVIDING PEI~LTIES FOR ~HE VIOLATION THEREOF, AND <br />PROVIDING THAT INVALIDITY O~ PARTS SHALL NOT AFFECT ~HE VALIDITY <br />OF REMAINDER. ~_ . <br />On motion of Mr. ~tsh~ins, said ordinance was adopted and by the following <br /> <br /> A~es: Fox, Grimes, Hall, HOward, Hutchins,Lawrence, ~arren, Wilson <br /> Nays; None <br /> <br />Report of the Accounting DePartment for the month of July was presented, and <br /> <br /> - NEW BUSINESS - <br /> <br /> Bill of J. Shirley Hope, S~ate Game Warden, for destroying sixty tagless dogs, <br /> at $2. 50 each, totaling $150.00~ was received, and on motion of Mr. Ho;card, the Treasurer was <br /> authorized to pay same from ~funds in her hands from collection of Dog Taxes. <br /> <br /> The FollOwing letter was read: <br /> <br /> "On September 22nd, 1940, the City of Portsmouth issued a Building Permit <br /> ~8925 to the Texas Oil Company for the cons~ruction of additions and improvements to their ser- <br /> vice station at Court and Wyt~he Sts. <br /> I later contracted with 2he Texas Company ~o make the improvements, and in <br />order to widen one of ~he driveways in accordance with the plans, I requested the Chesapeake & <br />Potomac Telephone Company of Ulrginia to move one of their poles located on Court St. The Tele- <br />phone Company has refused ~o move this pole unless I agree to pay them the sum of $150.00. <br /> The propert~ on which the service station is located l'~ owned by the Texas <br />Company for the sole purpose of conducting a drive-in station. The above mentioned pole is <br />located on the property of the City in such a location as to interfere with the proper use of <br />the property as a service station. <br /> It is my understanding th~_t the contract between the City and the Telephone <br />Compemy, covering the use of city property for nolo lines, requires the Telephone Company to <br />move at their expense poles which interfere wit4 the public use of th~ Property. <br /> I respectfully request that you require the Telephone Company to move this <br />pole at its expense as it restricts the use of the adjoining property by the lawful owners. <br /> <br />Yours very truly, <br /> <br />power to act, <br /> <br /> Motion of Mr. <br />was adopted. <br /> <br /> F. A. Duke, Genersl Contractor." <br />Howard to refer to the 0ity Manager and City Attorney, with <br /> <br /> Compensation report of the Oommisaloner of B~venue, for the month of July, <br />was received, and on moti~ of Mr. Hutchins, ~oproved for payment. <br /> <br /> Repomt of F. B. Hill & Company, Certified Public Accountants, for auditing <br />the ferry books and a¢counzs for the month of June, was received and ordered filed. <br /> <br /> Motion of Mr. H~ward that a committee, including the City Manager and City <br />Attorney, be appointed to work out a pension system for all employees of the City, was adopted. <br /> <br /> The Chair appointed the following committee: <br /> <br />Messrs.
