379 <br /> <br />Seotember 25rd, 1941. <br /> <br />dwelling units of a number at least equal to the <br />number of new dwellings .to be provided in the Pro- <br />ject less the number of unsafe or insanitary dwell- <br />lng units t8 be eliminated fr6& the site of the <br />Project by the Authority during the development <br />thereof. <br /> <br />The City agrees to eliminate such unsafe or insani- <br />tary dwelling units within the territorial limits <br />of the City. <br /> <br />The City agrees to eliminate such unsafe or insani- <br />tary dwelling units in one or the c thsr of the fol- <br />lowing ways or partly in one of these ways and partly <br />in ~ncther: <br /> <br />By demolishing dwelling units which are on land <br />acquired by the City by purchase or otherwise in - <br />eluding demolition ~ f such dwelling units on land <br />purchased for'any public uses; <br />By causing the compulsory demolition, effective <br />closing, repair or improvement of such unsafe or <br />insanitary dwelling units; or <br /> <br />(iii) <br /> <br />(e) <br /> <br />By inducing private owners voluntarily to eliminate <br />such dwelling units. <br /> <br />In computing the number of unsafe or i~sanitary dwelling <br />units eliminated under the terms of this Agreement, there <br />shall be included all unsafe or insanitary 'dwelling units <br />eliminated under this Agreement from the date hereof; pro- <br />vided, however, tha$ si1 unsafe or insanitary dwelling <br />units eliminated by.the City prior to the date of this <br />Agreement and~subsequent to the date o f the organization of <br />the Authority, to-wit September 13, 1938, will be counted <br />as elimination under this Agreement if e~idence is furnished, <br />satisfactory to the USHA., that such unsafe or insanitary <br />dwelling units were eliminated in anticipation o f the Project. <br />In computing ~he number of unsafe or insanitaz~ dwelling <br />units eliminated under'the terms of this Agreenent, the reme- <br />dying of violations of local building codes or ordinances by com- <br />pulsory actio~ of the City, in so far as it results in the e!imi- <br />nation of unsafe or insanitary dwelling units, ~hall be consi - <br />doted as elimination. The voluntary remedying of such violations <br />shall not be 8onsidered as elimination. <br /> <br />For the purpose of this Agrement, a dwelling unit shall be con- <br />sidered unsafe or insanitary whenever by reason of di!~idation, <br />faulty arrang&ment or design, lack of ventilation, light or san- <br />itation facilities or any combination o f these factors, it is <br />detrimental t6 safety, health or morals. <br /> <br />The 0ity agreSs to eliminate such unsafe or insanitary dwelling <br />units withimmone year from ~he date on which the Project is <br />substantially'ready in its entirety .for oec~oancyo" <br /> <br /> 2.
