October 28th~ 1941. <br /> <br /> The regular meeting of the City Council was held October 28th, 1941, at ?:00 <br />P.M., with the following members present: <br /> <br /> Leslie T. Fox~ George L. Grimes~ Russell M~ Hall, James NJ Howard, <br /> W. R. Hutchins~ ~ank Ds Lawrence.~C. E~ Warren~ Pearls J~ Wilson <br /> and M.E. Haug~ City Manage= <br /> <br /> Minutes of regular meeting held October 14th were read and approved. <br /> <br /> The following communications from the City Msnager were read~ <br /> <br /> let ~On October lOth, Edward P~ Levine made application, under the zoning <br />law~ to erect a theatre on the northeast corner of Lincoln St. and Des Moines Avenue. <br /> Within the time limit set by the law, I have received two petitions, <br />one signed by Joe. F. ~nits and others and Roy M. Woodard and others. ~nother petition was re- <br />ceived yesterday~ signed by Rev. D. S~ Detpsey and others. Under the provisions o f the law, I <br />respectfully submit these protests ~o the City Council,~ <br /> <br /> The following petitions were read~ <br /> <br /> ~We~ the undersigned members and friends of the Jackson Memorial Baptist <br /> Church a~ citizens of said community do take this opportunity to register our protest against <br /> the location of theatre so near our church; namely on Lincoln St~ and Des Moines Ave. <br /> It is our belief that a thre~e in this community would be detrimental both <br /> to the moral and spiritual life of our people, thenefore we are opposing such in said communit <br /> <br />tSigned) D. Roy Mo Woodard, Mrs. <br />Jos. F. ~nite, Mr. Butler~ Rev. Vernon L. Fisher, ReV. D. S. Dempsey, Rev. Jas. W. Smith,Jr., <br />and others, requested that the permit be not granted and Mr. Edward P. Levine s~oke in favor <br />of the permit° <br /> <br />Motion of Mr. Grimes to lay the matter on the table was adopted. <br /> <br /> 2nd - "I am attaching hereto contract between the City of Portsmouth and the <br />City of Norfolk, whi~ch covers the proposed City of Norfolk water supply line from ~he westCity <br />limits of Portsmouth to the Southern Railway Company's piers at the Port Warden's line of the <br />Elizabeth-River. <br /> This contract has been approved by our City Attorney and has be~. <br />adopted by the City Council of the City of Norfolk. I therefore respectfully recommend that <br />the acting Mayor be authorized to sign it~~ <br /> <br /> Mo~ion of l~r. Hu~chins to lay the contract on the t able until next meeting, <br />was adopted. <br /> <br /> 3rd - ~I am attaching hereto an smendment to Section 76 of the License Tax <br />Ordinance which will oermit the licensing of automatic photogr~p~hic machines, carrying ali - <br />cerise ts_x fee of $R6.~O per annum. I respectfully recommend that this amendment be adopted." <br /> <br />was adopted: <br /> <br />Motion of Mr. Hutchins to place the following ordinance on its first reading, <br /> <br /> "AN ORDINANCE TO A2MEND SECTION ~6 OF THE ~LICENBE TAX <br /> ORDINANCE BY ADDING A NEW PARAGRAPH THERETO." <br /> <br /> 4th - "I am presenting a formal offe~ made by the Federaz ~or~s A~ency, De - <br />fense Public Works Division~ which covers our applicatzon for funds to assist in constructing <br />improvements to our Water Department. <br /> T~his offer is in the form of a gr=n~ of $2~7,22,.00 to the Cz~y of <br />Portsmouth, in order to finance construction estimated to cost $462,O4Oo00~ leaving a balance <br />to be borne by the City amounting to ~184,816,0Oo T~his offer is on the basis of a sixty per <br />cent and supercedes the original offer of a thirty per cent grant which was made by the Govern~ <br />ment on ~ePtember 4th and w~ch was not accepted by the City~ The increased grant is the re- <br />sult of conferences ~th officials of the Federal Works Agency, <br /> i recommend that the offer is accepted and that we be authorized to <br />sign the necessary papers which have already been executed by the Director of Defense Public <br />Works~~ <br /> <br /> Mr. Hutchins presented the following resolution which~as~ on motion of Mr. <br />Hu~chins adopted~ and by the following vote,:~ <br /> <br /> Ayes: Fox~ Grimes~ Hal!~ Howard, HutcP~tns, Lawrence, Warren, Wilson <br /> Nays: None <br />Re solution - <br /> FWA Form NO~ l!8~L(b) F~W.A~ 6!92~! <br /> I~PJESOLUTION, oRDINANCE, oRDER) <br /> ACCEPTING THE OFFER OF THE UNITED STATES OF A~{ERICA <br /> <br /> <br />
