Fox, Russell-M. Hell, James No Howard, <br />Hutchins, Frank D. La~rence, O.E.Warren,Pearle~J.Witeon and Arthur <br /> Owens, 0ity Manager. <br /> <br />Minutes of regular meeting held February ~th were read and approved. <br /> <br /> The following communications from theOity Msnager were read: <br /> <br /> 1st - ~'I woul~ appreciate an appropriation of $2,800.00 to defray the <br />salarY and exnepse of the Ga~e Warden ~or the remainder of the fiscal.year 1943.s <br /> <br />Notion of Mr. Fox to lay on table until next meeting, was adopted. <br /> <br />and <br /> <br /> 2nd - "The City of ~ortsmouGh, Virginia, and the Commission of Game <br />Inland Fisheries have this day made an agreement with respect to dog law enforcement. <br /> It is recommended that the attached agreement be approved." <br /> <br />Resolution - <br /> <br />"WHEREA~, the City of Portsmouth, unier th~ provisions <br />of the Acts of 1937, Chapter 25~ (with amendments)~ <br />is to provide its own Game Wa~ien, and <br /> WHEPJ~AS, the Commission of Game ~and Inland ~isheries <br />have caused to be ex~cu~ed threugh thelr Executive Di- <br />rector an agreemen~ for the Oity to take over the Dog <br />Enforcemen~ law <br /> NOW, TP~REFORE, Be it Resolved by th4 Council of the <br />Ci~y of Portsmomth, Virginia, that said .agreement be- <br />t~$n the Oemmisslon of Game a~d Inland Fisheries and the <br />Oity o f Portsmouth b e executed and that proper officers <br />be authorized to ~gn it," <br /> <br />Agreement - <br /> <br />"AGREEMENT BETWEEN THE COMMISSION OF GA~EA~D INLAND <br />FISHERIES A~ THE OITYO~ PORTSMOUTH WITH RESPECT TO <br />DOG LAW ENFORO~iENT. <br />This Agreement made this day of 1943, <br />between the Commission of Game and Inland Fisheries, <br />hereinafter called the party of the first part and the <br />City of-Portsmouth, hereinafter called the party of the <br />second par~ <br /> <br /> WITNESSETH <br />1. The Police of£ioers of the party of the second part, <br />or such officer with police powe~s as the party of the <br />second parZ~may designate, shall enforce all dog laws in <br />the Oity of Portsmouth, under the powers conferred by <br />law upon such officer as ex-officio game warden. Persons <br />violating such laws shall be prosecuted'under the provi- <br />sions of Oh~n~er 24?, Ac~s 1930, and all amendments there- <br />to, and~such officers or offioer~shallmake'the reports <br />required of game wardens to the party of the first part. <br />2. The_party of the second par~ shall maintain and oper- <br />ate a suitabl~ dog pound at such convenient point in the <br />city as it may de£ermine which shall be under the juris - <br />diction of such officer whose duty it shall be to dispose <br />of unlicensed dogs placed therein. However, any unlicensed <br />dog in ~aid.pound shall be held for a minimum of 48 hours <br />before being executed in order ~o afford the owner an oppor- <br />tunity to mdeem said dog by paying a fee for keep not in <br />excess of 25 cents per day; provided said owner produces <br />the required license for said deg, The party of the second <br />part shall be relieved of paying ~he fee of $2.50 for each <br />dog killed. <br />3- The party of the first part assumes no responsibility <br />for thepayment or hire of police officers of the second <br />party assigned to perform these duties. <br />4. T2~e~party of the first part is required by law to en- <br />force all provisions of the dog law and will from time to <br />time send its representatives to aid and work with such <br />officer as the party of the ~cond part shall designate to <br />see that the provisions of the law are being carried out by <br />the party of~the ~cond part. It is agreed that the repre- <br />senZatives of the par~y of the second part will co-operate <br /> with the representatives of the~party of the first part <br />at any and all times. <br /> Thio agreement maY be amended at any time by mutual con- <br />sent and may also be canceled upon Shitty days written notice <br />from either party. <br /> 0ON~ISBION OP GAME AND INdia.
