<br />The following communications from the City Manager were read: ~

<br />1st - The Manager presented the following resolution:
<br />
<br />"Be it Resolved by the City Council of the City of Portsmouth,
<br />Virginia, in regular meeting assembled, that the ~ayor of said
<br />City be, and he h~reby is, authorized to enter into an agree -
<br />merit wi~h the Atlantic Coast Line Railroad 0ompany~ and to sign
<br />same on behalf of said Oity, whereby the said Railroad Company
<br />gives and grants un~o the said City the right and privi!eg~ to
<br />lay and maintain, for the purpose of conducting water, a 24 inch
<br />cast iron pipe across the right of way and underneath the main
<br />track of said P~ilroad Company at Suffolk, Virginia, at a point
<br />2y~2 feet southwesterly, measured along the center line 6 f said
<br />main track, from mile post 19 ( f~om Pirhuers Point); as particu-
<br />larly described in said agreement, which agreement is dzted
<br />April yth, 1943."

<br /> 3rd - "R.E. Culpeppe~, formerl~ a member off-the Portsmouth Fire Depart -
<br />ment, is enZitled to a ref,zud of one-half the amoun~ deducted from his salary for the Pension
<br />Fund, which is $26.58.
<br /> I recommend that Mr. Culpepper be re-imbursed in this mmount."

<br /> Motion of M~. Wilson ~0 concur in the Manager's recommendation, was adcpte~

<br /> kth - "Mr. Angelo Luoenti, ~rading as Meade Construction Company, who en-
<br />tered into a contract with the City under date of July 29~, 1942, for the work under Division
<br />A, Additions to Sanitary Sewer System, F.W.A. Docket ~VA ~.-l~l, stopped work on the project
<br />on May 14th, 19~3. As directed by your resolution passed on May l~th, 19~3,
<br />by registered mail a letter in the following words:

<br />and known as Division A. F.W.A. Docket No. VA 45-141, in accordance with said contract and
<br />the plans and specifications accompanying the same, and for the further reason theft you with-
<br />drew your organization ~nd completely abandoned the work reo~ired by said contract on May
<br />1943, you are hereby notified tha~ pursuant to ~he provisions of said contract the City o f
<br />Portsmouth has no alternative other~than to terminate your right to proceed with t he work and
<br />to call upon your surety company to make good any loss sustained.
<br /> Your sure~y is being notified of your default and at the oro-I
<br />per time, demand Will be made upon it by the City for the fulfillment and completion o f s~id
<br />Division A contract according to the plans and specifications.
