<br />ceived on April 12th, 1944; the following letter from the City Engineer is self-explanatory:

<br /> 'In response to our advertisement for bids that were opened on
<br /> April 12th, 194~, in connection with the paving of London St. from
<br /> Effingham St. to Second Ave. and Second Ave. from Glasgow St. to
<br /> High St., three proposals were received, w~hich are as fellows:

<br /> Asphalt Paving Service, P~tchmond, Va. $ 86,705.50
<br /> Ames and ~ebb, Norfolk~ Va. 83'775'00
<br /> Phil H~ McGuire, Norfolk, Va. 92,732.50

<br /> The Asphalt Paving Service's proposal is the lowest. ~ut their
<br />bid exceeds the funds available by $18,775.OO. After careful
<br />study of presen~ da~ costs, I feel that their bid i~ reasonable.
<br />They are a very reputable firm and I believe they will give us a
<br />good Job. If all bids are rejected and new bids are asked for,
<br />I do not believe we will get a betterp~ice. Therefore, i tee -
<br />pect~ully recommend that the proposal of the Asphalt Paving Ser-
<br />vlcs~ Inc. be accepted, provided an additional appropriation to
<br />cover the difference is made by the Council.'

<br /> ~e are faced with curtailing the work by approximately twenty per cent or
<br />requesting an additional appropriation to complete the work.
<br /> It is my recommendation that an appropriation of $18,7~5. OO be made in
<br />order that we may complete the paving of this s~re$~."

<br /> ~THIS AGREEMENT, made the 25th day of April, 1944, between the Virginia
<br /> ~mel~ing~C~mpany~ a corporation of the State of Main~, party of the first oart, th~
<br /> oun~y cz ~orfolk~ acing through its Board of Supervisors, party of the sebond part~
<br /> and the City of Portsmouth party of the third part~ (the last two being political
<br /> subdivisions of the State of Virginia~.

<br /> WHE.REAS, the City of ~rtsmouth owns and operates a system of water
<br />works in the. City of Portsmouth and portions of ~orfolk County for the purpose of
<br />supplying wat~er to the inhabitants o~ said localities and for fire protection; and
<br />
<br /> W~EER~EAS, the Virginia Smelting Company and the Board of Supervisors
<br />of Norfolk County are desirous of having the water system ~tended across t~e West-
<br />ern Branch of the Elizabeth River to t~hat portion of the County.~nown as West Nor -
<br />folk,
<br /> NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That in consideration of
<br />the premises and the benefits to be derived by the Virginia Smelting Company and
<br />by the County of Norfolk and its inhabitants, and the mutual promises herein con -
<br />rained, the parties covenan~ &nd agree with each other as follows$

<br /> ~l) The City of Portsmouth agrees that as soon as all the terms and
<br />conditions of this contract have been complied with, it ~ll cause to be constructed
<br />from its present water main at the intersection o f Bay View Boulevard and Florida
<br />Avenue in the City of Portsmouth across the ~estern Branch of the Elizabeth River
<br />to a point in the public road in West Norfolk leading to the West Norfolk drsw -
<br />bridE~, a ten inch cast iron water main in a subaqmsous trench fo~ the ouroo~e of
<br />suppIying pure water fit for drinking purposes ~bothat section of-Norfo~k 0ounty
<br />known as WeSt Norfolk.
<br /> (2) ~ne sa-m parties agree that the said pipe lzne will be con -
<br />structed as soon as all necessary riMhts of way and all necessary permits have
<br />been obtained, and a satisfa0tory contract has be~n mad~ with a contractor accept-
<br />able to the City of Portsmouth for the purpose of laying said mains for a sum so
<br />that the total costs of said mains including engineering and incidental costs will
<br />not exceed Thirty Thousand Dollars. Should the said ~ipe line cost more than Thir-
<br />ty Thousaad Dollars, it will be optional with th~ ~£ty of Portsmouth as to whether
<br />it will construc~ the same, and should it be impossible to construct said water
<br />mains ~.~thin three years from the date hereof, thls contract shall become void.

<br /> (3) The Virginia Smelting Company s~d the County of Norfolk agree
<br />to pay to the City of Portsmouth as soon as it receives bids and is r~ady to award
<br />a contract for the construction of said main each the sum of Ten Thousg~nd Doliars,
<br />or i~ the event the to~al cost ie less than Thirty Thousand Dollars, one-third of
<br />the ~ctal cost of constructing the mains, including engineering fees and other
<br />
<br /> (4) The Virgini~ Smelting Company agrees~and gUarantees tc purchase
<br />from the City o f Portsmouth for the period of three~ years from the time said water
<br />mains have been completed and 01aced in service, water to the amount of Five Thou -
<br />sand Dollars per annum, and until the expiration~f the contract or until the gross
