August i3:1996 96-269 - Use permit; 52;3 Motion by Mr. Robinett, and seconded by Mr. Pitts, to adopt the following 'resolution, approved on first reading at the August 12, 1996 Public Hearing meeting, and was adopted by the following vote: 96-269 (b): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A WASTEWATER PUMPING STATION FOR THE WILLIAMS COURT RESIDENTIAL DEVELOPMENT. WHEREAS, Beacon Construction Company has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct and operate a wastewater pumping facility to be located in the Williams Court residential development, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Beacon Construction Company is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the construction and operation of a wastewater pumping facility on property located in the Williams Court residential development, and being more particularly described as; UP-96-10 Beginning at a point approximately 1,196 feet from the northeastern intersection of Victory Boulevard and Deep Creek Boulevard and northeast approximately 635 feet along the property line of (western) Rack and Sack Shopping Center / Victory Village Apartment thence northwest 40+ feet to a point; thence northeast 46+ feet to a point; thence southeast 44 + feet to a point; thence southeast 23+ feet to a point; thence southwest 21+ feet to a point; thence southwest 15+ feet to the point of beginning.
