536: <br /> <br />August 27, 1996 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That the United House of Prayer for All People is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the 3500 Greenwood Drive, and being more particularly <br />described as: <br /> <br />UP-96,09 <br /> <br />Beginning at a point 350'+_east of the northeast corner of the <br />intersection of Victory Boulevard and Greenwood Drive; thence, <br />north 364'_+ to a point; thence, east 225'+_to a point; thence, in a <br />southeasterly direction 233'+_ to a point; thence west 45'+__to a point; <br />thence, south 100'+_ to a point; thence, west 280'_+ to the point of <br />the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The proposed church shall be limited to the 2.140 acre portion of the <br />site that fronts on Greenwood Drive. <br /> <br />(b) Occupancy of the sanctuary shall be limited to 220 seats. <br /> <br /> (c) The applicant shall submit a site plan providing parking and <br />landscaping for approval by the Engineering Department. <br /> <br /> (d) The applicant shall submit a building plan for approval by the Building <br />Official. <br /> <br />(e) Access to the drive shall be limited to Greenwood Drive. <br /> <br /> (f) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and <br />maintain in effect all necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br /> <br />
