<br />Ca Suction Lines and SucTion Wells at 12 o'clock noon on
<br />February 7th, 1945, and the proposals were tabulated and,
<br /> WHEREAS, the proposal s~omitted by Jarcho
<br />Norfolk, Virginia, of $133~599.00 was fo~d to b e the
<br />lowest bid and being in order~
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of
<br />the City of Portsmouth, Virginia, that the proposal of
<br />Bros., be accepted and the contract for said work be awarded
<br />the above-mentioned bidder, subject tc the approval of the
<br />FederalWorks Agency of the United ~tates, end that the City
<br />Manager be authorized ~o execute said contract on behalf of
<br />the City with the seal of the City affixed, attested by the

<br /> The following letter was read:

<br /> '~It has been brought ~o the attention of the members of this ~ssociation
<br />that on the 1st day of tb~s year, the retired members of the ~olice and Fire Departments re -
<br />c~ved an inorease in pay. This matter has created some concern amongst the members of our
<br />Association, in view of the fact Of the language ~sed in the Retirement Act. A meeting was held
<br />of the Portsmouth Police Relief Association on February 2nd, 1945, and the following resolution
<br />was unanimously passed: That the President address to your Hcnorgole body a letter requesting
<br />that the City Attorney furnish the Association a ~itten opinion in r efferents ~o the following
<br />inquiries~ ~

<br /> within the ~erms of the Retirement Act, does that crea~e a conrractura! re-
<br /> lationsk~p between the retired employee .and the City of Portsmouth.
<br /> 2nd - In the event tb~t it does create a contractural relationship, is it the
<br /> posi$ion of the City that the pension of the retired employee cs~ be in-
<br /> creased or decreased a~ the option of the City.
<br /> 3rd - if the retirement of a member of the Police or Fire Department does not
<br /> create a con~ractural relationship between the retired employee and the
<br /> City, what is the status of a retired employee in reference to the pension
<br /> received by him.
