August 27th~ 19!6, the CoUncil of the City of Portsmouth for the past sixteen years; he having first entered upon his du- ties on September 1st, 1930; AND, WEEREAS,~af~e~ long and'faithful service, Mr. Hutchins is VolUntarily retiring from the City Co-~nci! because of his health, after long and faithful '~' AND, WHEREAS,'the membems of the Council sincemely regret ~h~t they will b e deprived ef the talents of M~. Muirhead Construction-Company, Contractors on Contract No. C b-4, Docked VA 44-141~, did substantially complete all construction work on the above said Contract on June 2t, 194~ which date is in. excess of the 240 consecutive calendar days~ stipulated in Art. 28 of the Contract for time of completion, by 208 calendar days. THEP~FORE, BE IT RESOLVEDt~ha~ the City of Portsmouth acknow- ledge~ this delay was due to conditions beyond the contractor,s control a~d Furthermore this delay did not accrue any actual damages to the City of PortSmouth; BE IT ~JRTHER RESOLVED t~at the' City of Portsmouth hereby grants the ~Lm. Muirhead~Construction Compsny an extension of Contract time in~e ~no~ut of 20~' consecutive calendar days and also waives any ClaLm for liquidated damages, all o f w~hich is in accord with a~ticle 39 oF the Contract~d~cuments and subject to the approval of the Federal Works Agency."
