<br /> The steps encroach upon the Randolph Street approximately four feet and
<br />~were erected new as an a~unct to the building or~ Mond~, No~ember
<br /> A building permit was issued to A. Katz on F~ d~, No~embe~ I, 1~6,
<br />to remodel the store in the building and no mention w as made o~ building a stairway on
<br />street to the se~ nd floor:a~a~tm~nt. Saturday was a.half holzday a nd Sunday a ~hole holzday
<br />and on Mond~ the CztyEng_nee~ discovered the st~s ~ust afte~ they.Were lifted zn place ~nd
<br />gave notice that they must be removed. However, the contractor contznued working and ~mplet-i
<br />ed the steps after he a nd the owner had been notified the same could not be erected on t he
<br />street.
<br /> The steps a~e o f mill construction and no doubt were constructed some
<br />time before the building permit was issued.
<br /> The Planning a~d Zoning 0~dinance adopted by the City Council in 1945
<br />has the following provision:
<br />
<br />"No new building including porches~ shall hereafter be erected beyond
<br />the street~ line, and no porch, bay window, o r portico shall be altered
<br />or repaired so as to extend further~to the street than i t ex~ends at
<br />the time of the passage of this ordinance in any District."
<br />
<br /> Since the passage of the Zoning Ordinance ntuae~ous ~pplicatiems have
<br />been denied to erect ~tructures upon the streets and several people have been required t o re-
<br />move the porches after they were partly constz?ucted. Appeals were m~de to the Blm~nzng Cc~ -
<br />mission in one or more of the cases and the applications were rejected by the Commission.
