May 22, 2001 <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Frances W. Steward is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />children's toy store at 516 Middle Street Mall, and said property being more particularly <br />described as: <br /> <br />UP-01-10 <br /> <br /> Beginning at the southwest corner of High Street and <br />Middle Street Mall; thence in a southerly direction 175.94'+ to a <br />point; thence, in a westerly direction 69'+ to a point; then in a <br />southerly direction 51.46'+ to a point; thence in a westerly <br />direction 15'+ to a point; thence, in a northerly direction 85'+ to <br />a point; thence, in a easterly direction 27.63'+ to a point; <br />thence, in a northerly direction 142.5'+ to a point of the <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) Use of the property shall be limited to a retail children's toy store with <br />incidental food sales. <br /> <br /> (b) The hours of operation shall be limited to 10:00 a.m. through 6:00 p.m., <br />Monday through Saturday, and 1:00 p.m. through 5:00 p.m. on Sunday. <br /> <br /> (c) All signage and exterior renovations must be approved by the Downtown <br />Design Committee prior to commencement of any work. <br /> <br /> (d) The applicant shall develop a plan for trash storage, handling, and <br />removal and shall submit the plan for approval to the Director of General Services. <br /> <br /> (e) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />01 - 164 - Public hearing on proposed increases to water, sewer and refuse rates; and <br />on higher collections for cigarette, guest lodging, personal property (boats) and real <br />estate due to increases in assessments. <br /> <br />City Manager Stuck indicted that the initial recommendation for an increase to the <br />boat tax had been withdrawn. <br /> <br /> <br />
