May 22, 2001 (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Victoria W. Connelly is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a restaurant on property located at 53 Afton Parkway, and being more particularly described as: UP-01-09 Beginning at the northeast intersection of Emmons Street and Afton Parkway thence north approximately 73 feet along the eastern right-of-way line of Emmons Street to a point; thence east approximately 100 feet to a point; thence south approximately 73 feet to a point; thence west approximately 100 feet along the northern right-of-way line of Afton Parkway to the point of beginning. 3. That the use permit is approved subject to the following conditions: (a) No more than fifty people shall occupy the property at any one time. (b) p.m. The hours of operation shall be limited to between 11:00 a.m. and 11:00 (c) The structure shall be inspected annually by the City's Fire Prevention Bureau, Public Health Department, and Building Official, and the applicant shall promptly correct any deficiencies noted. (d) The applicant and any successor in interest shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (e) The applicant shall develop a plan for trash storage, handling, and removal and shall submit the plan for approval to the Director of General Services. (f) All taxes and fees in connection with the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 01-149(c): "A RESOLUTION GRANTING A USE PERMIT TO FRANCES W. STEWARD FOR THE OPERATION OF A CHILDREN'S TOY STORE AT 516 MIDDLE STREET MALL. WHEREAS, Francis W. Steward has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a children's toy store (S.I.C. 5945) at 516 Middle Street Mall, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions.
