May 22, 2001 <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Victoria W. Connelly is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />restaurant on property located at 53 Afton Parkway, and being more particularly <br />described as: <br /> <br />UP-01-09 <br /> <br /> Beginning at the northeast intersection of Emmons <br />Street and Afton Parkway thence north approximately 73 <br />feet along the eastern right-of-way line of Emmons Street to <br />a point; thence east approximately 100 feet to a point; <br />thence south approximately 73 feet to a point; thence west <br />approximately 100 feet along the northern right-of-way line of <br />Afton Parkway to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br />(a) No more than fifty people shall occupy the property at any one time. <br /> <br /> (b) <br />p.m. <br /> <br />The hours of operation shall be limited to between 11:00 a.m. and 11:00 <br /> <br /> (c) The structure shall be inspected annually by the City's Fire Prevention <br />Bureau, Public Health Department, and Building Official, and the applicant shall <br />promptly correct any deficiencies noted. <br /> <br /> (d) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all necessary licenses and permits. <br /> <br /> (e) The applicant shall develop a plan for trash storage, handling, and <br />removal and shall submit the plan for approval to the Director of General Services. <br /> <br /> (f) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />01-149(c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO FRANCES W.
