May 22, 2001 <br /> <br /> The amount to be deposited to the credit of the Clerk of the Circuit Court of the <br />City of Portsmouth for said parcel is $2,250.00." <br /> <br />Ayes: Benn, Griffin, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br />Abstained: Moody (Mr. Moody abstained because Wayne E. Smiley is his son-in-law). <br /> <br />01 - 173 - Adoption of a resolution authorizing the City Manager to convey several <br />parcels of property and easements in the South Waterfront area to the Industrial <br />Development Authority (IDA) for the development of the waterfront. <br /> <br />These conveyances are necessary to finalize property transactions for the Ocean <br />Marine Project. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to convey several parcels of <br />property and easements in the South Waterfront area to the Industrial Development <br />Authority. <br /> <br />· These conveyances are necessary to finalize property transactions for the Ocean <br />Marine Project. <br /> <br />Purpose and Need: <br /> <br />· Resolution Parcel 1 calls for the conveyance of Parcel 2 on the plat of Subdivision of <br />Harbor Center Section One. This conveyance is required as the Development <br />Agreement between IDA and Ocean Marine calls for IDA to encumber Parcel 2 with a <br />permanent parking easement in favor of Ocean Marine. <br /> <br />· Resolution Parcel 2 for the conveyance of the North Pier is required because the <br />Development Agreement calls for that pier to be encumbered by IDA with a covenant <br />which essentially forbids the use of the North Pier for businesses and operations that <br />would be competitive with Ocean Marine's operations. The Development Agreement <br />further calls for IDA to provide for easements along the north, east and western edges <br />of the North Pier site for ingress, egress and utilities. <br /> <br />· Resolution Parcel 3 for the conveyance of the South Inlet is included to insure all <br />parties and particularly bond lenders that riparian rights of the South Inlet are to be <br />included in the Lease. This particular conveyance also calls for the riparian rights of the <br />City in those parcels which the City owns adjoining the South Inlet so that IDA may <br />lease those riparian rights along with the South Inlet to Ocean Marine. Ocean Marine <br />asserts this is needed to insure that the inlet is totally within their control, save and <br />except preserved docking rights of the City. <br /> <br />· Resolution Parcel 4 insures the right of IDA and its subsequent owners to drain <br />storm water from Parcels 1 and 2 on the Plat of Harbor Center Section One into storm <br />drain easements reserved and dedicated within property now belonging to IDA at the <br />rear of the nTelos site and across a portion of the nTelos site. <br /> <br />· Resolution Parcel 5 is necessary in order to provide IDA with the ability to provide to <br />Ocean Marine an easement for vehicular and pedestrian access over the paved <br />driveway which runs from the intersection of Water and Columbia Street around and <br />parallel with the Seawall and provides access to the parking lot beneath City Hall. <br /> <br />· Resolution Parcel 6 provides that the City will convey to IDA a utility easement and <br />underground easement for fuel storage tanks immediately adjacent to the south side of <br />the City Hall complex. The use of these facilities will be leased to Ocean Marine in <br />order that utilities and gas and fuel for marine vehicles may be supplied to the marina. <br /> <br />Financial Impact: <br /> <br />· Development of this area should enhance the tax base of the City. Assessments for <br />facilities as constructed will reveal the extent of such enhancement. <br /> <br /> <br />
