590 <br /> <br />November 26. 1996 <br /> <br />U~96218 <br /> <br />Beginning at the southwestern intersection of Harris Road and Reid Street thence <br />west 70 feet along the southern right-of-way line of Harris Road to a point; thence <br />southeast 100 feet to a point; thence west 124 feet to a point; thence northwest 100 <br />feet to point; thence east 100 feet along the southern right-of-way line of Harris <br />Road to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to eight children, no more than <br />five of which shall be under 2-1/2 years of age. <br /> <br /> (b) Indoor hours of operation shall be limited to the hours of 5:30 A.M. <br />through 6:00 P.M. Outdoor play hours shall be limited to the hours of 10:00 A.M. to <br />6:00 P.M. <br /> <br /> (c) Prior to occupancy and at least annually thereafter, the facility shall <br />request an inspection by the Fire Prevention Bureau, the Public Health Department <br />and the Building Official and shall correct any noted deficiencies. <br /> <br /> (d) The facility shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br />(e) The use permit shall not be transferable. <br /> <br /> (f) The project shall be developed ~n accordance with the submitted site and <br />floor plans, identified as Exhibits A and B and made a part hereof. The referenced <br />plans may be modified as required for the purpose of the health and safety of the <br />children, and any such changes shall be approved in advance by the Building Official <br />or other appropriate City officer. ' <br /> <br /> 4. EXPIRATION OF PERMIT: If operation of the facility is not commenced <br />within two years of the date hereof, the use permit shall expire. <br /> <br /> 5. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit bY the City Council." <br /> <br />96-374 (c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT (UP-96-20) TO DELORES AND <br />JOHN SPEARS FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT <br />1407 HAMILTON AVENUE. <br /> <br /> WHEREAS, Delores and John Spears have made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />granting of a use permit to operate a child day care facility to be located at 1407 <br />Hamilton Avenue, Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br />use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> <br />
