November 26, 1996 (g) Indoor hou rs of operation shall be limited to the hours of 6:00 A.M. to 6:00 P.M. Outdoor play hours shall be limited to [he hours of 10:00 A.M. to 6:00 P.M. (h) The facility shall be inspected annually by the City's Fire Prevention Bureau, Public Health Department and Building Official and any deficiencies shall be corrected: (i) The applicant shall comply with ail applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses and permits. (j) All applicable real estate taxes, personal property taxes, and. business license taxes owed on or in connection with the property shall be timely paid. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council 5. That this ordinance shall take effect on the date of its adoption." 96-374 (b): "A RESOLUTION GRANTING A USE PERMIT (UP-96-18) TO NICKY AND KAREN BAGGETT FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 4 HARRIS ROAD. WHEREAS, Nicky and Karen Baggett have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child day care facility to be located at 4 Harris Road, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicants and [he Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Nicky and Karen Baggett are hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child day care facility on property located at 4 Harris Road, and being more particularly described as:
