January14.1997 <br /> <br />97-05 - Public Hearing on rezoning and use permit applications: <br /> <br />(a) Z-96-10 <br /> <br />TRUXTUN NEIGHBORHOOD - Rezoning application of Donald <br />Baker to modify the existing Commercial C-2-K zoning classification <br />to allow auto wholesale activities at 2200 Frederick Boulevard. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Berm, to concur with the <br />recommendation of the Planning Commission that Z-96-10 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(b) UP-96-24 TRUXTUN NEIGHBORHOOD - Use permit application of Don Baker <br /> to operate an auto wholesale business at 2200 Frederick Boulevard. <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Robinett, to concur with the <br />recommendation of the Planning Commission that UP-96-24 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(c) UP-96-26 <br /> <br />HIGHLAND BILTMORE NEIGHBORHOOD - Use permit application <br />of Matt Dauer to operate a private club at 3426 Deep Creek <br />Boulevard. <br /> <br />1. Matthew Dauer, 3560 Kentucky Trail, provided information in support of the <br />proposed use permit. <br /> <br />2. Janis Dauer, 2072 Iowa Street, spoke in support of the proposed use permit. <br /> <br />3. Michelle Davis, 115 Charles Avenue, spoke in opposition to the proposed use <br />permit. <br /> <br /> Motion by Mr. Benn. and seconded by Mr. Griffin, to concur with the <br />recommendation of the Planning Commission that UP-96-26 be denied, and was <br />adopted by the following vote: <br /> <br />Ayes: Berm. Clemons, Griffin, Martin. Pitts. Robinett, Holley <br />NaYs: None <br /> <br />(d) UP-96-27 RIVER PARK NEIG ~IBORHOOD - Use permit application of New <br /> Jerusalem Family Church to operate a church at 3120 High Street. <br /> <br /> Motion by Mr. Martin. and seconded by Mr. Pitts. to concur with the <br />recommendation of the Planning Commission that UP-96-27 be denied, and was <br />adopted by the following vote: <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts. Robinett, Holley <br />Nays: None <br /> <br />(e) UP-96-28 DOWNTOWN NEIGHBORHOOD - Use permit applications of <br /> Norman Malbon to operate an ice cream shop at 507 Middle Street. <br /> <br /> Motion by Mr. Pitts. and seconded by Mr. Martin, to accept the applicant's <br />withdrawal request, anc was adopted by unanimous vote. <br /> <br />96-408 ~ Use Permits: <br /> <br />96-408 (a): <br /> <br />- UNFINISHED BUSINESS - <br /> <br /> Motion by Mr. Martin, and seconded by Mr Robinett, to adopt the following <br />resolution, approved on first reading at the December 17 1996 Public Hearing <br />meeting, and was adopted by the following vote: <br /> <br /> <br />
