January14.1997 97-05 - Public Hearing on rezoning and use permit applications: (a) Z-96-10 TRUXTUN NEIGHBORHOOD - Rezoning application of Donald Baker to modify the existing Commercial C-2-K zoning classification to allow auto wholesale activities at 2200 Frederick Boulevard. Motion by Mr. Robinett, and seconded by Mr. Berm, to concur with the recommendation of the Planning Commission that Z-96-10 be approved on first reading, and was adopted by unanimous vote. (b) UP-96-24 TRUXTUN NEIGHBORHOOD - Use permit application of Don Baker to operate an auto wholesale business at 2200 Frederick Boulevard. Motion by Mr. Martin, and seconded by Mr. Robinett, to concur with the recommendation of the Planning Commission that UP-96-24 be approved on first reading, and was adopted by unanimous vote. (c) UP-96-26 HIGHLAND BILTMORE NEIGHBORHOOD - Use permit application of Matt Dauer to operate a private club at 3426 Deep Creek Boulevard. 1. Matthew Dauer, 3560 Kentucky Trail, provided information in support of the proposed use permit. 2. Janis Dauer, 2072 Iowa Street, spoke in support of the proposed use permit. 3. Michelle Davis, 115 Charles Avenue, spoke in opposition to the proposed use permit. Motion by Mr. Benn. and seconded by Mr. Griffin, to concur with the recommendation of the Planning Commission that UP-96-26 be denied, and was adopted by the following vote: Ayes: Berm. Clemons, Griffin, Martin. Pitts. Robinett, Holley NaYs: None (d) UP-96-27 RIVER PARK NEIG ~IBORHOOD - Use permit application of New Jerusalem Family Church to operate a church at 3120 High Street. Motion by Mr. Martin. and seconded by Mr. Pitts. to concur with the recommendation of the Planning Commission that UP-96-27 be denied, and was adopted by the following vote: Ayes: Benn, Clemons, Griffin, Martin, Pitts. Robinett, Holley Nays: None (e) UP-96-28 DOWNTOWN NEIGHBORHOOD - Use permit applications of Norman Malbon to operate an ice cream shop at 507 Middle Street. Motion by Mr. Pitts. and seconded by Mr. Martin, to accept the applicant's withdrawal request, anc was adopted by unanimous vote. 96-408 ~ Use Permits: 96-408 (a): - UNFINISHED BUSINESS - Motion by Mr. Martin, and seconded by Mr Robinett, to adopt the following resolution, approved on first reading at the December 17 1996 Public Hearing meeting, and was adopted by the following vote:
