<br /> "In Aug~st, 1948, the Attorney General fo~ the State of Virginia, issued
<br />it mandatory that whenever any person was arrested, regardless of the viola-

<br />a ruling and made
<br />rich, before that person c.ould be incarcerated or,stained, that the arresting officer must
<br />cume a criminal warrant, in duplicate, one to be kept&St the records and the other delivered
<br />to the person arrested, a~ the time of arrest.
<br /> This ruling and procedure has caused ~he Justices of the Peace, repre-
<br />senting the City of Portsmouth, Va. to w~ite many warrants for the City in order to carry out
<br />this ruling that heretofore never existed and we are called at amy hour of the day or night,to
<br />serve the City of Portsmouth in this respect.
<br /> Up to this date, the City of Portsmouth, Va. has made no effort to com-
<br />p&~s~te the Justices of the Peace for this servmce rendered, yet I have a copy of the letter
<br />that was directed to Mr. L.C. B~inson, City Clerk and Auditor, from Judge Wm. H. 0asr, Judge
<br />of the Portsmouth Police and Domestic Relationship Court, which states in part that his court
<br />was assessing an additional fifty cents to the cost of Cour$, fo~ ail convictions.
<br /> We certainly feel justified in requesting that tt~ City of Portsmouth
<br />Va. compensate us for t~[s service s_nd regardless of tk~ defendsmt being found guilty or ac-
<br />quitted, we, the Justices of the Peace, have served tb~ City well and faithful, incurz~lng
<br />some expense and utilizing our time, for as I ~s. ve said before, we are called to serve the
<br />City at any hour of tl~ day or night.
<br /> The State of Virginia pays us for all warrants pertaining to State casez
<br />and we areonly asking that the City of Portsmouth pay-us at the rate of fifty cents each, f c~
<br />the warrants that we issue pertaining to City violations.
<br /> Trusting that I may receive a reply~at yo~ earliest convenience advis-
<br />ing what procedure we must follow in order to coilect~o~ the services-that we render to the

<br />and direct them to proceed mn~nedmately wmth the collection and/or sale of this real estate on
<br />whichthere is more than five years delinquent taxes due.
<br /> For you~ informati~, Norfolk County has assigned certain names
<br />in alphabeticaI order to one Attorney and all money collected from his group, he receives ~thi~-
<br />ty three and one third p~r ce~t of it. In the case of a suit for this collection, the Attorney
<br />is allowed whatever fee the Judge shall prescribe for his services.
<br /> There are several hundred thousand dollars of delinquent real es-
<br />tate taxes on ~r books at the present time and I an of the opinion that this money should be
<br />collected now."
