030 <br /> <br />Januaw 28.1997 <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement: and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Donald R. Baker is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virg nia (1988) for the operation of an <br />auto wholesale business on property located at 2200 Frederick Boulevard. and being <br />more particularly described as: <br /> <br />UP-96-24 <br /> <br /> Beginning at the southwest intersection of Frederick Boulevard and Dahlia <br />Street; thence, south along the western right-of-way of Frederick Boulevard <br />approximately 280'+ to a point; thence, northwest 105'+_to a point; thence, north <br />approximately 302'+ to a point; thence, east along the southern right-of-way of Dahlia <br />Street approximately 150'+ to the point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The site shall be developed in accordance with a site plan approved by <br />the City Engineer. <br /> <br /> (b) Hours of operation shall be limited to 7:30 a.m. to 6:30 p.m., Monday <br />through Saturday. <br /> <br /> (c) Dahlia Street shall not be used for ingress and egress and shall remain <br />blockaded. <br /> <br /> (d) No more than tWenty vehicles shall be permitted on the site at any one <br />time for wholesale. <br /> <br />(e) All vehicles for wholesale Shall be operable and in good body repair. <br /> <br /> (f) All vehicles stored at the site shall have current license plates, city decals <br />and a state inspection or rejection sticker. No vehicle shall be stored on the site for <br />more than fourteen (14) consecutive days. All vehicles, other than employees' cars <br />parked on the property, will have a repair invoice. No more than fifteen (15) vehicles <br />shall be on the property awaiting repair. No tires or batteries shall be stored outside <br />of the building. <br /> <br />(g) All fencing on site shall be maintained in good repair. <br /> <br /> (h) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City COuncil. <br /> <br /> 5. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-106.1 of the Code of the City of Portsmouth, Virginia (1988), the use permit shall <br />expire if a building permit, certificate of occupancy, commercial reinspection, <br />business license, or any other required authorization or permit is not issued and if <br />the use has not commenced within two years of the date of hereof." <br /> <br /> <br />
